Se’if 1א׳
המניח הכד ברה"ר ונתקל בו אחר או טען כד ונתקל ונשבר והשופך מים לרשות הרבים והזיקו. ובו ה סעיפים: המניח את הכד ברה"ר ובא אחר ונתקל בו ושברו פטור שאין דרך בני אדם להתבונן בדרכים ואם הוזק בו בעל הכד חייב ואפי' הפקיר הכד שכל המפקיר נזקיו בדבר שאין לו רשות לעשות מתחלה חייב:
One who places a jar in the public domain and another stumbled on it; or one carrying a jar who stumbled and it broke; and one who pours water into the public domain, and they did damage; it contains five se'ifim. One who places a jar in the public domain, and another came and stumbled on it and broke it, is exempt, for it is not the way of people to look closely along the roads; and if he was injured by it, the owner of the jar is liable — and even if he declared the jar ownerless; for whoever declares ownerless the things of his that damage, in a matter he had no right to do in the first place, is liable.
Se’if 2ב׳
הניח הכד במקום שיש לו רשות להניחו כמו במקו' פנוי שלפני בית הבד ובא אחר ונתקל בו ושברו חייב ואם הוזק בו המהלך בעל הכד פטור מפני שהי' לו להסתכל ואם היתה אפיל' או שמילא כל הדרך כדים פטור על שבירתן ואם נתקל בה והוזק בעל הכד חייב וכן כל כיוצא בזה ואם מילא כל הדרך כדים שאי אפשר לעבור אפילו שברו בידים פטור ומיהו אם בשעה ששיברם הוזק בחרסיה פטור אע"פ שזה מילא כל הדרך דאיהו דאזיק אנפשיה:
If he placed the jar in a place where he has the right to place it — such as the vacant place in front of the olive press — and another came and stumbled on it and broke it, he is liable; and if the passer-by was injured by it, the owner of the jar is exempt, for he should have looked. And if it was dark, or he filled the whole road with jars, he is exempt for breaking them; and if he stumbled on it and was injured, the owner of the jar is liable; and likewise in every similar case. And if he filled the whole road with jars so that it is impossible to pass, even if he broke them with his hands, he is exempt. However, if at the time that he broke them he was injured by their shards, the owner is exempt, even though this one filled the whole road; for it is he who damaged himself.
Se’if 3ג׳
ודוקא אדם אין דרכו להסתכל בדרכים אבל בהמ' שעיני' למטה דרכה לעיין אנה תלך לפיכך אם נתקל' והוזקה בכד המונח בר"ה פטור בעל הכד ואם שברתו דרך הילוכה הוה ליה רגל ופטור דרך ביעוט הוה ליה קרן וחייב:
And specifically a man, whose way is not to look along the roads; but an animal, whose eyes are downward, its way is to look where it is going. Therefore, if it stumbled and was injured by a jar lying in the public domain, the owner of the jar is exempt; and if it broke it in the course of its walking, it is foot, and exempt; by way of kicking, it is horn, and liable.
