Se’if 1א׳

שמין השוורים לניזק ואם פיחתו או הותירו. ובו ג סעיפים: שמין השוורים בנזיקי' אם שבר כלי הוא או בהמתו א"א יתן לו כלי שלם ויקח השברים אלא שמין כמה נפחתו דמיו בשביל השביר' ויקח הניזק השברי' והמזיק ישלים עליהם:

The oxen are appraised for the one damaged, and where they decreased or increased in value; it contains three se'ifim. They appraise the oxen in damages: whether he himself broke a vessel or his animal did, he does not give him a whole vessel and take the broken pieces; rather, they appraise how much its value decreased because of the breaking, and the one damaged takes the broken pieces, and the one who damaged makes up the difference on them.

Se’if 2ב׳

פחת הנביל' לניזק ושבח הנביל' חולקים אותו המזיק והניזק כיצד שור שוה מאתים שנגחוהו ומת והרי הנביל' שוה בשעת מיתה מאה ובשעת העמד' בדין פחת' והרי שוה פ' אין המזיק משלם אלא ק' ואם היה תם משל' לו נ' מגופו (נ"י) (ודוקא שנודע לניזק בשעת מיתה אבל אם לא נודע לו הפחת על המזיק עד שיוודע לניזק וי"א דה"ה אם הוזלה (טור ס"ח) ויש חולקין דבזולא אע"ג דלא נודע ליה הוי של ניזק) (נ"י פ' הנ"ל) השביח' הנביל' והרי היא שוה בשעת העמד' בדין ק"כ הרי המזיק משלם תשעים ואם היה תם משלם מ"ה מגופו וזהו וגם את המת יחצון: הגה מיהו אם השביחה כל כך שחצי שבח הוא יותר מדמי ההיזק לא אמרינן דהמזיק יטול חצי השבח וירויח (טור):

A fall in the value of the carcass is the loss of the one damaged, and a rise in the value of the carcass the one who damaged and the one damaged divide. How so? An ox worth two hundred that they gored and it died, and the carcass is worth a hundred at the time of death, and at the time of standing in court it fell in value and is worth eighty — the one who damaged pays only a hundred, and if it was not forewarned he pays him fifty from its body (Nimukei Yosef) (and specifically where the one damaged knew at the time of death; but if he did not know, the fall in value is upon the one who damaged until it becomes known to the one damaged; and some say that the same law applies if it became cheaper) (Tur, se'if 8) (and there are those who disagree, that with a fall in price, even though he did not know, it is the one damaged's) (Nimukei Yosef, the chapter mentioned). If the carcass rose in value and is worth a hundred and twenty at the time of standing in court, the one who damaged pays ninety; and if it was not forewarned, he pays forty-five from its body. Hagah [Rema]: However, if it rose so much that half the rise is more than the value of the damage, we do not say that the one who damaged should take half the rise and profit (Tur).

על המזיק לטרוח בנביל' עד שממציא אותו לניזק כיצד כגון שנפל השור לבור ומת מעלה הנביל' מהבור ונותנ' לניזק ואח"כ שמין לו פחת נביל' שנאמר כסף ישיב לבעליו והמת יהי' לו מלמד שהוא חייב להשיב את הנביל' ואת הפחת שפחת' מן החי לניזק ואם היה תם חצי הפחת:

It is upon the one who damaged to take the trouble with the carcass until he delivers it to the one damaged. How so? For instance, the ox fell into a pit and died: he brings the carcass up from the pit and gives it to the one damaged, and afterwards they appraise for him the fall in value of the carcass; as it is said, "he shall give money to the owner of them, and the dead beast shall be his" — this teaches that he must return the carcass, and the loss by which it lost value from the live animal, to the one damaged; and if it was not forewarned, half the loss.
