ב' שוורים שחבלו זה בזה והן תמים או מועדים. ובו סעיף אחד: ב' שוורים תמים שחבלו זה בזה משלמים במותר חצי נזק כגון אם אחד הזיק בחבירו שוה ק' והשני הזיק שוה נ' יצאו חמשים בחמשים והנ' הנותרי' ישלם לו חצים ואפי' נאבד האחד ודוקא ששוה כל אחד דמי נזקו אבל אם אינו שוה כ"כ אינו מנכה לו רק מה שיוכל לגבות מגופו (נ"י שם) ואם שניהם מועדים משלמים במותר נזק שלם ואם היה אחד תם ואחד מועד מועד בתם שהזיק המועד לתם יותר ממה שהזיקו ישלם במותר נזק שלם כגון אם הזיק מועד בתם מאה והתם לא הזיקו אלא נ' משלם לו ע"ה תם במועד ישלם לו חצי נזק כגון שהזיק תם במועד ק' והמועד לא הזיקו אלא כ"ה משלם לו כ"ה: הגה י"א דכל זה מיירי דוקא שהתחילו בבת אחת או לאחר שנפרדו זה מזה חזר השני וחבל בראשון אבל אם א' התחיל המתחיל משלם והשני פטור דכל המשנה ובא אחר ושינה (בו) פטור (טור בשם הרא"ש) וכן הוא לקמן סי' תכ"א סעיף י"ג לענין שני אנשים שחבלו זה בזה והמחבר שפסק כאן כמי שחולק וס"ל שאין לחלק ולקמן פסק כמו שכתבתי לא כוון יפה:

Two oxen that wounded one another, when they are not forewarned or forewarned; it contains one se'if. Two oxen not forewarned that wounded one another pay half damage on the excess. For instance, if one did damage to its fellow worth a hundred, and the second did damage worth fifty, fifty are set off against fifty, and for the remaining fifty he pays him half of them — even if one of them was lost. And this is specifically where each is worth the value of its damage; but if it is not worth so much, he deducts for him only what he could collect from its body (Nimukei Yosef there). And if both are forewarned, they pay full damage on the excess. And if one was not forewarned and one forewarned: a forewarned one against one not forewarned — if the forewarned one damaged the one not forewarned more than it was damaged by it, he pays full damage on the excess; for instance, if the forewarned one damaged the one not forewarned a hundred and the one not forewarned damaged it only fifty, he pays him seventy-five. One not forewarned against a forewarned one — he pays him half damage; for instance, if the one not forewarned damaged the forewarned one a hundred and the forewarned one damaged it only twenty-five, he pays him twenty-five. Hagah [Rema]: Some say that all this speaks specifically where they began at the same moment, or where, after they separated from one another, the second came back and wounded the first; but if one began, the one who began pays and the second is exempt, for whoever deviates, and another came and deviated (against him), is exempt (Tur in the name of the Rosh). And so it is below, siman 421, se'if 13, regarding two people who wounded one another; and the author, who ruled here like the one who disagrees and holds that one does not distinguish, and below ruled as I have written, was not precise.
