An ox that gored and gored again, and where the one damaged seized and it gored again; it contains two se'ifim. An ox that gored and then gored another ox — the first one damaged and the owner are as partners in it. How so? An ox worth two hundred that gored an ox worth two hundred, and the carcass is worth nothing: the one damaged takes a hundred and the owner of the ox a hundred. If it then gored another ox worth two hundred, and the carcass is worth nothing, the last takes a hundred, and the one damaged before him together with the owner take fifty zuz each. If it then gored an ox worth two hundred, and the carcass is worth nothing, the last takes a hundred, the one damaged before him fifty, and the first one damaged together with the owner twenty-five each; and in this way they go on dividing.

One damaged who seized the animal that damaged, to collect his half damage from its body, has become a paid bailee over it as regards damages; and if it went out and damaged, the first one damaged is liable for its damages and the owner is exempt. How so? An ox worth two hundred that gored and caused a loss of two hundred, and the one damaged seized it to collect a hundred from it, and it then gored and caused a loss of a hundred and forty: the last one damaged is paid seventy, the first one damaged, who seized it, is paid the excess of his damage, which is thirty, and the owner a hundred; and likewise everything like this. Hagah [Rema]: And some say that there is no distinction whether he seized it or did not seize it; in every case the one damaged loses only half, and the owner half (Tur in the name of the Ri and the Rosh).
