Se’if 1א׳
שור שהיה רודף אחר חבירו או שנים רודפים או שנים נרדפים. ובו ד סעיפים: שור שהיה רודף אחר שור אחר והוזק זה אומר שורך הזיק וזה אומר לא כי אלא בסלע לקה המוציא מחבירו עליו הראי' אפי' ניזק טוען ברי ומזיק טוען שמא ואם טען הניזק אתה יודע ששורך הזיק נשבע היסת שאינו יודע בד"א במועד אבל בתם פטור אף מהיסת שהרי אם הוד' היה פטור הואיל והוא קנס:
An ox that was pursuing another, or two pursuing, or two pursued; it contains four se'ifim. An ox that was pursuing another ox, and it was injured; this one says, "Your ox damaged," and that one says, "No — rather, it was struck on a rock": the one who would take from his fellow bears the burden of proof, even where the one damaged pleads with certainty and the one who damaged pleads "perhaps". And if the one damaged pleaded, "You know that your ox damaged," he swears the oath of hesset (the oath the Sages imposed on one who denies a claim outright) that he does not know. In what case are these words said? With a forewarned one; but with one not forewarned he is exempt even from the oath of hesset, for if he had admitted, he would be exempt, since it is a fine.

היו שנים רודפים אחר אחד והרי עדים שא' מהם הזיק ואינם יודעים איזה משניהם זה אומר שורך הזיק וזה אומר שורך הזיק שניהם פטורים ואם היו של איש א' חייב לשלם מגוף הפחות שבשניהם ואם היו מועדים משלם נזק שלם מנכסיו בד"א ששני השוורים עומדים אבל אם מת אחד מהם או אבד והיה אחד מהם תם אע"פ שהם של איש אחד פטור שהרי אומר לו הבא ראי' שזה העומד הוא שהזיק ואשלם לך:
If two were pursuing one, and there are witnesses that one of them damaged, but they do not know which of the two — this one says, "Your ox damaged," and that one says, "Your ox damaged" — both are exempt. And if they belonged to one man, he must pay from the body of the lesser of the two; and if they were forewarned, he pays full damage from his property. In what case are these words said? Where the two oxen are standing; but if one of them died or was lost, and one of them was not forewarned, even though they belong to one man, he is exempt, for he says to him, "Bring proof that this one that is standing is the one that damaged, and I will pay you."

היו שני השוורים הרודפים אחד גדול ואחד קטן הניזק אומר הגדול הזיק והמזיק אומר קטן הזיק היה אחד תם ואחד מועד הניזק אומר מועד הזיק והמזיק אומר תם הזיק המוציא מחבירו עליו הראי' (לא היה שם ראי' ברור' שזה הזיק אלא עדים מעידים שא' משני אלו הזיק משלם המזיק כמו שאומר) ואם טען הניזק אתה יודע ודאי שזה הזיק בפניך הרי המזיק משלם מה שהודה ונשבע שבועת התור' על השאר הגה וי"א דאין כאן שבועה כלל דהו"ל כטענו חטין והודה לו בשעורים דפטור אף במה שהודה ואפי' תפס מפקינן מיניה (טור ס"ב בשם הרא"ש) ודוקא טען הניזק ברי אבל אם טוען שמא משלם המזיק כמו שהוא טוען (שם):
If the two pursuing oxen were one large and one small — the one damaged says, "The large one damaged," and the one who damaged says, "The small one damaged"; or one was not forewarned and one forewarned — the one damaged says, "The forewarned one damaged," and the one who damaged says, "The one not forewarned damaged": the one who would take from his fellow bears the burden of proof (if there was no clear proof there that this one damaged, but witnesses testify that one of these two damaged, the one who damaged pays as he says). And if the one damaged pleaded, "You know for certain that this one damaged in your presence," the one who damaged pays what he admitted and swears an oath by Torah law on the rest. Hagah [Rema]: And some say that there is no oath here at all, for it is as where they claimed wheat from him and he admitted barley, where he is exempt even from what he admitted; and even if he seized, we take it out of his hand (Tur, se'if 2, in the name of the Rosh). And this is specifically where the one damaged pleaded with certainty; but if he pleads "perhaps", the one who damaged pays as he pleads (there).
