Se’if 1א׳
פרה שהזיקה גובה מולדה ושור שנגח פרה מעוברת כיצד שמין אותה. ובו ה סעיפים: פרה מעוברת שהזיק' גובה חצי נזק ממנה ומולדה מפני שהיא כגופה אפי' ליתא לפרה משתלם כל חצי נזק מהולד מפני שהיא מגופה אבל תרנגולת שהזיק' אינו גובה מביצת' מפני שהביצה אינו מגופה אלא מובדלת ומופרשת: הגה מיהו אם הביצה אגודה עדיין בגופה י"א דגובין ממנה (המגיד פ"ט דנ"מ):
A cow that damaged — he collects from its offspring; and an ox that gored a pregnant cow — how it is appraised; it contains five se'ifim. A pregnant cow that damaged — he collects half damage from it and from its offspring, because it is as its body; even if the cow is not there, the whole half damage is paid from the offspring, because it is of its body. But a hen that damaged — he does not collect from its egg, because the egg is not of its body but is separated and set apart. Hagah [Rema]: However, if the egg is still bound up in its body, some say that they collect from it (the Maggid, chapter 9 of the Laws of Damage to Property).
Se’if 2ב׳
פרה מעוברת שנגח' ונמצא עוברה בצדה ואין ידוע אם קודם נגיח' ילדה ואז אין להשתלם מהולד או לאחר נגיח' ילדה ויש להשתלם מהולד ואין הפרה לפנינו המוציא מחבירו עליו הראי' ולא יטול מהולד:
A pregnant cow that gored, and its foetus was found beside it, and it is not known whether it gave birth before the goring — so that there is no payment from the offspring — or gave birth after the goring — so that there is payment from the offspring — and the cow is not before us: the one who would take from his fellow bears the burden of proof, and he does not take from the offspring.
Se’if 3ג׳
וכן שור שנגח את הפרה ונמצא עוברה מת בצדה ואין ידוע אם מחמת נגיחה הפיל' או אם הפילה קודם המוציא מחבירו עליו הראי' ואפי' שהניזק טוען ברי והמזיק טוען שמא ואפי' שאין המזיק מוחזק כגון שעומדת באגם פטור ואפי' משבוע': הגה מיהו אם תפס הניזק נאמן אם יש לו מיגו דלא היו דברים מעולם (טור בשם הרא"ש):
And likewise an ox that gored the cow, and its foetus was found dead beside it, and it is not known whether it miscarried because of the goring or whether it miscarried before: the one who would take from his fellow bears the burden of proof. And even where the one damaged pleads with certainty and the one who damaged pleads "perhaps", and even where the one who damaged is not in possession — for instance, it stands in the marsh — he is exempt, and even from an oath. Hagah [Rema]: However, if the one damaged seized, he is believed, if he has a migo (a plea he could have made in which he would have been believed) that these things never happened (Tur in the name of the Rosh).
