Se’if 1א׳
הכניס שורו לחצר חבירו שלא ברשות או נתן לו רשות להכניסו. ובו ה סעיפים: הכניס שורו לחצר חבירו שלא ברשות ונגחו שורו של בעל החצר פטור וכן אם הזיקו בעל החצר פטור שיכול לומר כיון שהכניסו שלא לדעת לא ידעתי בו עד ששגיתי בו ומיהו אם הזיקו לדעת חייב לשלם נזק שלם שאע"פ שיש לו רשות להוציאו מרשותו אין לו רשות להזיקו:
One who brought his ox into his fellow's courtyard without permission, or where he gave him permission to bring it in; it contains five se'ifim. If he brought his ox into his fellow's courtyard without permission, and the ox of the owner of the courtyard gored it, he is exempt. And likewise if the owner of the courtyard damaged it, he is exempt, for he can say, "Since you brought it in without my knowledge, I did not know of it, until I erred with it." However, if he damaged it knowingly, he must pay full damage; for even though he has the right to put it out of his domain, he has no right to damage it.
Se’if 2ב׳
הזיק שור הנכנס לבעל החצר או לשורו דינו כאלו הזיקו בר"ה ומשלם תם חצי נזק ומועד נזק שלם:
If the ox that entered damaged the owner of the courtyard or his ox, its law is as though it damaged him in the public domain, and one not forewarned pays half damage and a forewarned one full damage.
Se’if 3ג׳
קלקל את החצר כגון שחפר בו בורות שיחין ומערות בעל השור חייב בנזקי החצר ובעל החצר חייב בנזקי הבור מפני שהיה לו לסתמו:
If it spoiled the courtyard — for instance, it dug pits, ditches and caves in it — the owner of the ox is liable for the damages to the courtyard, and the owner of the courtyard is liable for the damages of the pit, because he should have stopped it up.
