Se’if 1א׳

כיצד שמירת תם ומועד או מסרן לשומר חנם או לשומר שכר. ובו י סעיפים: שור המועד וכן שן ורגל שהם מועדים מתחילתן די להם בשמיר' פחותה לפיכך אם קשרם בעליו במוסרה או שמרם שמיר' פחותה ויצא' והזיקו פטור בד"א במועד אבל תם לא סגי ליה לא במוסירה ולא בשמירה פחותה עד שישמרנו שמירה מעולה אי זו היא שמירה מעולה דלת שיכול' לעמוד אפילו ברוח שאינה מצויה ושמירה פחות' שיכולה לעמוד ברוח מצויה ולא בשאינה מצויה אבל אם אינה יכולה לעמוד אפילו ברוח מצויה כאלו לא שמרו כלל וחייב אפילו לא נפלה הדלת ע"י הרוח אלא לסטים הוציאו' או חפרה או חתר' הדלת והפילתו דתחילתו בפשיעה לגבי נפילת הדלת וסופו באונס לגבי חתירה וקיימא לן כל שתחלתו בפשיע' וסופו באונס הבא מחמת הפשיעה חייב אבל אם חתרה פרצה ויצא' משם פטור שאין האונס בא מחמת הפשיעה:

How one not forewarned and a forewarned one are guarded, or where he handed them over to an unpaid bailee or to a paid bailee; it contains ten se'ifim. A forewarned ox, and likewise tooth and foot, which are forewarned from the outset, suffice with lesser guarding. Therefore, if its owner tied them with a rein, or guarded them with lesser guarding, and it went out and damaged, he is exempt. In what case are these words said? With a forewarned one; but for one not forewarned neither a rein nor lesser guarding suffices, until he guards it with excellent guarding. What is excellent guarding? A door that can withstand even an uncommon wind; and lesser guarding is one that can withstand a common wind but not an uncommon one. But if it cannot withstand even a common wind, it is as though he did not guard it at all, and he is liable — even if the door did not fall through the wind, but robbers took it out, or it dug under, or broke through the door and knocked it down; for it began in negligence as regards the falling of the door and ended in mishap as regards the breaking through, and we hold that whatever begins in negligence and ends in a mishap that comes by reason of the negligence is liable. But if it broke through a breach and went out from there, he is exempt, for the mishap did not come by reason of the negligence.

Se’if 2ב׳

שמרה כראוי ונפרצה בליל' או שחתר' הדלת ויצאה והזיק' פטור אפי' ידע שנפרצה שאינו חייב לצאת לטרוח אחריה ודוקא נפרצה בליל אבל נפרצ' ביום חייב דקלא איתי למלתא ומסתמא ידע:

If he guarded it properly and it was breached at night, or it broke through the door and went out and damaged, he is exempt, even if he knew that it was breached, for he is not obliged to go out and trouble himself after it. And specifically where it was breached at night; but if it was breached by day he is liable, for the matter makes a sound, and presumably he knew.

Se’if 3ג׳

הוציאוה לסטים הם חייבים משעת משיכה או שהכישוה במקל להוציאה ודווקא שהוציאו' כדי לגזלה אבל הוציאוה כדי לאבדה פטורים:

If robbers took it out, they are liable from the moment of drawing, or if they struck it with a stick to take it out. And specifically where they took it out in order to rob it; but if they took it out in order to destroy it, they are exempt.
