Se’if 1א׳

הכניס פירותיו לחצר חבירו שלא ברשות והוזק בהן בעל החצר. ובו ד סעיפים: הכניס פירותיו לחצר (בעל הבית) שלא ברשות ואכלתן בהמתו של בעל הבית פטור (ואפי' הי' בעל החצר טוחן והביא זה חטים לטחון שישתכר בהן בעל החצר אפי' הכי מקרי שלא ברשות (טור ס"א) ואם הוחלקה בהם והוזקה בעל הפירות חייב ואם הכניס ברשות פטור (וי"ח (טור בסי' רצ"א וסימן שצ"ח בשם ר"י והרא"ש) כמו שיתבאר לקמן סוף סי' שצ"ח) ואם קבל עליו ב"ה לשמור את הפירות בעל הבית חייב:

One who brought his produce into his fellow's courtyard without permission, and the owner of the courtyard was damaged by it; it contains four se'ifim. If he brought his produce into the courtyard (of the householder) without permission, and the householder's animal ate it, he is exempt (and even if the owner of the courtyard was a miller, and this one brought wheat to grind from which the owner of the courtyard would earn, even so it is called without permission) (Tur, se'if 1). And if it slipped on it and was injured, the owner of the produce is liable. And if he brought it in with permission, he is exempt (and some disagree) (Tur in siman 291 and siman 398, in the name of the Ri and the Rosh; as will be explained below, end of siman 398). And if the householder undertook to guard the produce, the householder is liable.

Se’if 2ב׳

הכניסן שלא ברשות ואכלתן בהמתו של בעה"ב והוזקה באכילתן בעל הפירות פטור מפני שהי' לה שלא תאכל:

If he brought it in without permission, and the householder's animal ate it and was harmed by eating it, the owner of the produce is exempt, for it should not have eaten.

Se’if 3ג׳

הכניסן ברשות והניחו בעלי החצר את זה שהרשוהו בחצר לשמרו ואכלתן בהמתו של בע"ה והוזק' באכילתן בעל הפירות חייב שכיון שראה הבהמ' אוכלת דברים המזיקים לה והניח' חייב שהרי אין בעלי החצר מצויים שם להעביר הבהמ' מהם ומעשה באש' אחת שנכנס' בבית שכנתה ללוש ולאפות והניחוה ונתעלמו כדי שלא יביטו בה בעת לישת' ואפיית' ובא עז של בעה"ב ואכל הבצק ומת וחייבוה חכמים לשלם דמיו וכן כל כיוצא בזה:

If he brought it in with permission, and the owners of the courtyard left this one whom they had permitted in the courtyard to guard it, and the householder's animal ate it and was harmed by eating it, the owner of the produce is liable; for since he saw the animal eating things harmful to it and let it be, he is liable, for the owners of the courtyard are not present there to remove the animal from them. And there was an incident with a certain woman who entered her neighbour's house to knead and to bake, and they left her and withdrew so as not to look at her at the time of her kneading and her baking; and the householder's goat came and ate the dough and died, and the Sages obliged her to pay its value. And likewise everything like this.
