Se’if 1א׳

שן באיזה מקום ובאיזה אכילה משלם מה שהזיקה או מה שנהנית. ובו יב סעיפים: שן היא אב דושלח את בעירה (וביער) דכתיב בקרא מוקמינן לה נמי בבהמה שאוכלת פירות חבירו דברים הראוים לה ונהנית באכילתן חייב נזק שלם בין שאכלתן בין שלא אכלתן אלא שהפסידתן ולא כלתה אותם לגמרי לפיכך כל הדומה לזה שמזיק בדבר שהיא נהנית היא תולדה דשן כגון נתחככה בכותל להנאתה והזיקה או שטנפה פירות וכלים להנאתה כגון שנתגלגלה עליהם:

The tooth: in what place and for what eating one pays what it damaged or what it benefited; it contains twelve se'ifim. The tooth is the av (primary category) of "and shall let his beast loose" (and it feed) that is written in the verse; we apply it also to an animal that eats its fellow's produce — things fit for it — and benefits from eating them: he is liable for full damage, whether it ate them, or did not eat them but spoiled them and did not consume them entirely. Therefore everything resembling this, where it damages with a thing from which it has benefit, is a toladah (derivative category) of the tooth — such as where it rubbed against a wall for its pleasure and damaged, or it soiled produce and vessels for its pleasure, for instance it rolled on them.

Se’if 2ב׳

בד"א שאכלה דבר הראוי לה אבל אכלה דבר שאין ראוי לה כגון כסות וכלים שינוי הוא ואינו משלם אלא חצי נזק בין שאכלה אותם בחצר הניזק בין שאכלה אותם ברשות הרבים:

In what case are these words said? Where it ate a thing fit for it; but if it ate a thing not fit for it, such as clothing or vessels, it is a deviation, and he pays only half damage, whether it ate them in the courtyard of the one damaged or in the public domain.

אכלה דבר שאין דרכה לאכול אלא ע"י הדחק כגון פרה שאכלה שעורים וחמור שאכל כרשינין וכלב שלקק את השמן וחזיר שאכל חתיכת בשר וחתול שאכל תמרים חשיב שפיר אכילה אבל בהמה שאכלה בשר או תבשיל לאו אורחא הוא ומשלם חצי נזק אכלה פת הוי אורחא אבל חיה לאו אורחא לא בפת ולא בתבשיל:

If it ate a thing it is its way to eat only under pressure — such as a cow that ate barley, a donkey that ate vetch, a dog that lapped up oil, a pig that ate a piece of meat, and a cat that ate dates — it is properly reckoned eating. But an animal that ate meat or a cooked dish — that is not its way, and he pays half damage. If it ate bread, that is its way; but for a wild beast it is not its way, neither with bread nor with a cooked dish.
