Se’if 1א׳

נזקי רגל ותולדותיו ודיני צרורות וכלב ותרנגול שקפצו. ובו יב סעיפים: רגל היא אב שושלח את בעירה הכתוב בתורה הוא שהבהמה הולכת ברגליה ומזקת בדרך הילוכה והוא דבר שדרכה בכך ואין לה בו הנאה וכל הדומה לדברים אלו הוא תולדותיו ודינו כמוהו כיצד כגון שהזיקה בגופה דרך הילוכה או בשערה או בשליף (פי' הברטנורא בראשון מקמא שליף משאוי באמתחות ומרצופין) שעליה או בפרומביא (פי' רסן) שבפיה או בזוג שבצוארה או במשוי שעליה ותרנגולים שהיו פורחים ממקום למקום ושברו כלים בכנפיהם או שהיו מהדסין (פי' מהדסין ענין דריסה ורקידה) על גבי עיסה או פירות וטנפום או נקרו בהם וכן כל דבר המחובר בגופה כגון עגלה המושכת בקרון והוליכתה על גבי הכלים ושברתם כל אלו תולדות הרגל ודינם כמוהו:

Damage by the foot and its toladot, and the laws of pebbles, and a dog and a rooster that jumped; it contains twelve se'ifim. The foot is the av (primary category) of "and shall let his beast loose" written in the Torah: that the animal walks on its feet and damages in the course of its walking; and it is a thing that is its way, and it has no benefit from it. And everything resembling these things is of its toladot (derivative categories), and its law is as its law. How so? For instance, it damaged with its body in the course of its walking, or with its hair, or with the saddlebag (that is, the Bartenura on the first chapter of Bava Kamma: a shalif is a load in sacks and bags) that is on it, or with the bridle (that is, a rein) in its mouth, or with the bell on its neck, or with the load on it. And roosters that were flying from place to place and broke vessels with their wings, or that were hopping (that is, mehadsin is a matter of treading and dancing) on dough or produce and soiled them, or pecked at them. And likewise everything attached to its body — such as a cow drawing a wagon, and it drew it over vessels and broke them — all these are toladot of the foot, and their law is as its law.

כשכשה בזנבה כשכוש רב שאין דרכה לעשות תמיד והזיקה ברשות הרבים או שכשכשה בגיד שלה ברשות הרבים והזיקה פטור ואם תפס הניזק גובה חצי נזק ממה שתפס שזה הדבר ספק הוא אם אלו תולדות הקרן שחייב עליה ברשות הרבים או תולדות הרגל שפטור עליה ברשות הרבים: הגה וי"א דבכל ספקא דדינא לא מהני תפיסה ולכן אפי' אם תפס מפקינן מיניה (טור ס"א בשם ר"י ) (וע"ל סי' שכ"א) ולדעת הרא"ש דכשכשה בזנבה לא הוי ספק ודאי פטור (טור שם הביאו):

If it wagged its tail with a great wagging, which it is not its way to do always, and damaged in the public domain, or it wagged its member in the public domain and damaged — he is exempt; and if the one damaged seized, he collects half damage from what he seized, for this matter is a doubt, whether these are toladot of the horn, for which he is liable in the public domain, or toladot of the foot, for which he is exempt in the public domain. Hagah [Rema]: And some say that in any doubt in the law seizing is of no avail, and therefore even if he seized we take it out of his hand (Tur, se'if 1, in the name of the Ri) (and see above, siman 321). And according to the view of the Rosh, wagging with its tail is no doubt; he is certainly exempt (Tur brings it there).

כל תולדה כאב שלה חוץ מצרורות המנתזין מתחת רגלי הבהמה בשעת הילוכה שאע"פ שתולדות רגל הם ופטור עליהם בר"ה כרגל ואם הזיקו ברשות הניזק משלם מהיפה שבנכסיו כרגל שהוא אב אעפ"כ אינו משלם אלא חצי נזק כיצד בהמה שנכנסה לחצר הניזק והיו צרורות מנתזין מתחת רגליה ושברו את הכלים משלם חצי נזק מהיפה שבנכסיו ודבר זה הלכה למשה מסיני:

Every toladah is as its av, except pebbles that fly out from under the animal's feet at the time of its walking: for even though they are toladot of the foot, and he is exempt for them in the public domain as with the foot, and if they damaged in the domain of the one damaged he pays from the best of his property as with the foot, which is the av — nevertheless he pays only half damage. How so? An animal that entered the courtyard of the one damaged, and pebbles were flying out from under its feet and broke the vessels — he pays half damage from the best of his property. And this is a law given to Moses from Sinai.
