דין ניזק נשבע ונוטל. ובו טז סעיפים: המזיק ממון חבירו ואינו יודע מה הזיק נשבע הניזק ונוטל כיצד לקח כיס חבירו והשליכו למים או לאש או שמסרו ליד אנס ואבד בעל הכיס אומר: זהובים היה מלא והמזיק אומר איני יודע מה היה בו שמא עפר או תבן היה מלא הרי הניזק נשבע בנקיטת חפץ ונוטל והוא שיטעון דברים שהוא אמוד בהם או אמוד להפקיד' אצלו ודרכן להניחם בכיס וכיוצא בו (ארנקי בשק אם הוא שבת וי"ט מקרי דרכו בכך וכל כיוצא בזה) (מרדכי פ' הכונס) אבל אם אין דרכם להניחם בכלי זה והוא פשע בעצמו (ופטור המזיק) כיצד הרי שחטף חמת או סל מלאים ומחופים והשליכם לים או שרפם וטען הניזק שמרגליות היו בתוכה אינו נאמן (וי"א דאפי' היו עדים שהיו שם פטור הואיל ופשע כמו שנתבאר) (המגיד פ"ז דחובל בשם תוס' וע"ל ס"ק ו') ואם תפס אין מוציאין מידו (וי"ח (טור בשם הרא"ש) וישבע שמרגליות היה בתוכו ונוטל ממה שיש אצלו וכן כל כיוצא בזה ואם ידע המזיק שהכיס היה בו זהובים אבל אינו יודע כמה היו אם הניזק אומר אלף נוטל אלף בלא שבועה והוא שיהיה אמוד שהרי המזיק מחוייב שבועה ואינו יכול לישבע (וי"א דנשבע הניזק ונוטל וכן עיקר) (טור סי' צ' בשם הראב"ד והמגיד פ' הנ"ל והרא"ש):

The law of the one damaged who swears and takes; it contains sixteen se'ifim. One who damages his fellow's property and does not know what he damaged — the one damaged swears and takes. How so? If he took his fellow's purse and threw it into water or into fire, or handed it over into the hand of a violent man, and it was lost; the owner of the purse says, "It was full of gold pieces," and the one who damaged says, "I do not know what was in it; perhaps it was full of dust or straw" — the one damaged swears holding a sacred object and takes. And this is provided that he claims things he is assessed as having, or assessed as one with whom such things are deposited, and that it is the way to put them in a purse, and the like (a purse in a sack, if it is the Sabbath or a festival, is called its way, and everything like this) (Mordechai, chapter "One who brings in"). But if it is not their way to put them in this vessel, he himself was negligent (and the one who damaged is exempt). How so? If he snatched a leather bottle or a basket, full and covered, and threw them into the sea or burnt them, and the one damaged claimed that there were pearls in it, he is not believed (and some say that even if there were witnesses that they were there, he is exempt, since he was negligent, as was explained) (the Maggid, chapter 7 of the Laws of Wounding and Damaging, in the name of the Tosafot; and see se'if katan 6). And if he seized, they do not take it out of his hand (and some disagree) (Tur in the name of the Rosh), and he swears that there were pearls in it and takes from what he has with him; and likewise everything like this. And if the one who damaged knew that there were gold pieces in the purse but does not know how many there were: if the one damaged says a thousand, he takes a thousand without an oath, provided that he is assessed as having it, since the one who damaged is obliged to swear and cannot swear (and some say that the one damaged swears and takes, and so is the principal view) (Tur, siman 90, in the name of the Raavad, and the Maggid, the chapter mentioned, and the Rosh).

המוסר ממון בידי אנס בין אנס עכו"ם בין אנס ישראל חייב לשלם מהיפה שבנכסיו כל מה שלקח האנס אע"פ שלא נשא המוסר ולא נתן בידו אלא הרגיל בלבד ואם מת גובים מיורשיו כשאר כל המזיקים וי"א דדוקא שעמד בדין אבל אם לא עמד בדין אין היורשין חייבין לשלם ואשה שמסרה משמתינן לה ואם יש לה ממון שאין לבעל רשות בו משלמת ואם יש לה נכסי מלוג הבעל אוכל פירות כל ימי חייה ואם מתה חייב לשלם לנמסר וכן לשאר ניזק ואין הבעל לענין זה רק כיורש שחייב לשלם (מרדכי פ' החובל) בד"א כשהראה המוסר מעצמו אבל אם אנסוהו עכו"ם או ישראל אנס להראות והראה ה"ז פטור מתשלומין (ואם אנסו להראות שלו והראה [שלו ו]של חבירו חייב) (טור ס"א) ואם נשא ונתן ביד אע"פ שהוא אנוס חייב לשלם שהמציל עצמו בממון חבירו חייב כיצד הרי שגזר המלך להביא לו יין או תבן וכיוצא בדברים אלו ועמד מוסר ואמר הרי יש לפלוני אוצר יין או תבן במקום פלוני והלכו ולקחוהו חייב לשלם : הגה ואפי' יסרוהו ולא א"ל על מה והראה ממון חבירו חייב (טור שם) ולא מקרי אונס אלא הכאות ויסורין אבל לא אונס ממון (מרדכי פ' הגוזל בתרא ותשובת מיימוני דנזיקין סי"ב ונ"י) היה רואה נזק בא עליו מותר להציל עצמו אע"פ שע"י זה בא הנזק לאחר (נ"י פ' השותפין):

One who hands over money into the hands of a violent man — whether a gentile violent man or an Israelite violent man — must pay from the best of his property all that the violent man took, even though the informer did not carry it or give it with his hand but only led him to it. And if he died, they collect from his heirs, as with all others who damage. And some say that this is specifically where he stood trial; but if he did not stand trial, the heirs are not liable to pay. And a woman who informed — we place her under a ban; and if she has property in which the husband has no right, she pays; and if she has melog property (the property of hers whose fruits her husband eats), the husband eats the fruits all the days of her life, and if she dies he must pay the one informed against, and likewise any other one damaged; and in this matter the husband is only as an heir who must pay (Mordechai, chapter "One who wounds"). In what case are these words said? When the informer pointed it out of his own accord; but if gentiles, or an Israelite violent man, compelled him to point it out and he pointed it out, he is exempt from payment (and if they compelled him to point out his own and he pointed out his own and his fellow's, he is liable) (Tur, se'if 1). And if he carried it and gave it with his hand, even though he was under duress, he must pay, for one who saves himself with his fellow's money is liable. How so? If the king decreed that wine or straw or the like be brought to him, and an informer stood up and said, "So-and-so has a store of wine or straw in such-and-such a place," and they went and took it — he must pay. Hagah [Rema]: And even if they tormented him and did not tell him for what, and he pointed out his fellow's money, he is liable (Tur there); and it is called duress only with blows and torments, but not duress of money (Mordechai, chapter "One who robs, the latter", and Teshuvot Maimoniyot, Sefer Nezikin, siman 12, and Nimukei Yosef). If he saw damage coming upon him, he is permitted to save himself, even though through this the damage comes to another (Nimukei Yosef, chapter "Partners").

אנסו המלך למוסר זה עד שיראה לו ממון חבירו שהוא בורח מלפניו והראה לו מפני האונס ה"ז פטור שאם לא יראה לו יכהו או ימיתהו:

If the king compelled this informer to point out to him the money of his fellow, who is fleeing from him, and he pointed it out to him because of the duress, he is exempt; for if he did not point it out to him, he would strike him or kill him.
