Se’if 1א׳
דין אדם המזיק שלא בגופו. ובו ד סעיפים: א' המזיק בידו (או בשאר גופו) (טור ס"'א) או שזרק אבן או ירה חץ והזיק בו או שפטר (פי' שפתח) מים על חבירו או על הכלים והזיק או שרק ונע והזיק בכיחו (פי' רוק עב היוצא בכח) וניעו (פי' רוק דק שהולך ומתנועע) בעת שהלכו מכוחו ה"ז כמזיק בידו והם תולדות של אדם אבל אם רק הרוק והניח על הארץ ואח"כ נתקל מהם אדם ה"ז חייב משום בורו שכל תקלה תולדות בור הוא:
The law of a person who damages not with his body; it contains four se'ifim. One who damages with his hand (or with the rest of his body) (Tur, se'if 1), or who threw a stone or shot an arrow and damaged with it, or who released (that is, opened) water onto his fellow or onto vessels and damaged, or who spat and it moved along, and he damaged with his phlegm (that is, thick spittle that comes out with force) or his mucus (that is, thin spittle that goes along and moves) while they were going by his force — this is as one who damages with his hand, and they are toladot (derivative categories) of man. But if he spat the spittle and it came to rest on the ground, and afterwards a person stumbled on them, he is liable on account of his pit, for every stumbling-block is of the toladot of the pit.
Se’if 2ב׳
היה מכה בפטיש ויצא גץ (פי' שביב יוצא מתחת הפטיש כשמכין בו על הסדן) מתחת הפטיש והזיק ה"ז חייב:
If he was striking with a hammer and a spark (that is, a flake that comes out from under the hammer when one strikes with it on the anvil) came out from under the hammer and damaged, he is liable.
Se’if 3ג׳
הבנאי שקבל עליו את הכותל לסותרו ושבר את האבנים או הזיק חייב היה סותר מצד זה ונפל מצד אחר פטור ואם מחמת המכה חייב:
The builder who undertook to demolish the wall, and broke the stones or damaged, is liable. If he was demolishing on this side and it fell on another side, he is exempt; and if it was on account of the blow, he is liable.
