Se’if 1א׳
דין אדם המזיק לבהמת חבירו. ובו ה סעיפים: הניח גחלת על לב שור חבירו כשהוא כפות ונשרף או שדחפו לים חייב ואם הניח גחלת על לב חבירו ונשרף יתבאר בסימן תי"ח:
The law of a person who damages his fellow's animal; it contains five se'ifim. If he placed a live coal on the heart of his fellow's ox while it was bound, and it was burnt, or he pushed it into the sea, he is liable. And if he placed a live coal on his fellow's heart and he was burnt, it will be explained in siman 418.
Se’if 2ב׳
שור שעלה על גב שור להורגו ברשות הניזק שהוא בעל התחתון בין שהיה תם בין שהיה מועד ובא בעל התחתון ושמט את שורו להצילו ונפל עליון ומת הרי זה פטור דחפו לעליון ומת אם היה יכול לשומטו ולא שמטו ה"ז חייב ואם לא היה יכול לשומטו הרי זה פטור: הגה וכן ראובן שלקח כלי של שמעון וסמך בו חביתו של יין שלא יפול ובא שמעון ונטל כלי שלו ונשבר חביתו של יין שמעון חייב דה"ל לסמכו בדבר אחר (תשו' הרא"ש כלל ק"א סי' ג'):
An ox that climbed on the back of an ox to kill it, in the domain of the one damaged, who is the owner of the lower one — whether it was not forewarned or forewarned — and the owner of the lower one came and pulled his own ox out to save it, and the upper one fell and died: he is exempt. If he pushed the upper one and it died: if he could have pulled his own out and did not pull it out, he is liable; and if he could not pull it out, he is exempt.
