Se’if 1א׳

דין היזק שאינו ניכר כגון מנסך יינו של חבירו. ובו ב סעיפים: המזיק את חבירו היזק שאינו ניכר כגון שעירב יין נסך ביינו מן התורה הוא פטור אבל חכמים קנסוהו לשלם נזק שלם מהיפה שבנכסיו כדין כל המזיקים לפיכך אם מת המזיק קודם שישלם אין קונסין בנו אחריו לשלם וכן אם היה שוגג או אנוס פטור שלא קנסו אלא מזיד:

The law of damage that is not discernible, such as one who pours his fellow's wine as a libation; it contains two se'ifim. One who damages his fellow with a damage that is not discernible — for instance, he mixed yayin nesach (wine poured out as an idolatrous libation) into his wine — is exempt by Torah law, but the Sages fined him to pay full damage from the best of his property, as the law of all who damage. Therefore, if the one who damaged died before he paid, they do not fine his son after him to pay; and likewise if he acted unwittingly or under duress, he is exempt, for they fined only one who acts deliberately.

Se’if 2ב׳

המנסך יין חבירו לעכו"ם לא נאסר שאין אדם מישראל אוסר דבר שאינו שלו ואם היה לו בו שותפות או שהיה מומר שהרי הוא כעכו"ם או שהתרו בו וקבל ההתראה שהרי הוא מומר ה"ז אוסר היין וחייב לשלם אע"פ שהוא מתחייב בנפשו מפני שמשעה שהגביהו נתחייב לשלם ואינו מתחייב בנפשו עד שינסך:

One who pours his fellow's wine as a libation to idolatry has not rendered it forbidden, for an Israelite does not render forbidden a thing that is not his own. And if he had a share in it, or he was an apostate — for he is as a gentile — or they warned him and he accepted the warning, for then he is an apostate, he renders the wine forbidden and must pay, even though he incurs the penalty of death, because from the moment he lifted it he became liable to pay, and he does not incur the penalty of death until he pours the libation.
