הקוצץ אילן של חבירו והמונע חבירו מלעשות מצוה. ובו סעיף אחד: שור שהיה עומד להריגה מפני שהוא מזיק את הבריות ואילן העומד לקציצה מפני שהוא מזיק את הרבים וקדם אחד ושחט שור זה וקצץ אילן זה שלא מדעת הבעלים חייב לשלם לבעלים כמו שיראו הדיינים שהרי הפקיעם מלעשות מצוה ואם טען ואמר אתה אמרת לי להרגו ולקצצו הואיל והוא עומד לכך ה"ז פטור (אבל שאר מזיק אינו נאמן לומר שהוא נתן לו רשות (טור ס"ג) אפי' יש לו מיגו לומר לא הזקתי כגון דליכא עדים שהזיקו דהוי כמיגו במקום חזקה דלא הוי מיגו (מרדכי ונ"י פ' החובל) אבל נאמן לומר (לא הזקתי) [נ"א אתה אמרת לי וכו'] במיגו דלא היה שלך מה שהזקתי אלא שלי היה (מרדכי שם) וכן מי ששחט חיה ועוף ובא אחר וכיסה הדם שלא מדעת השוחט חייב ליתן כמו שיראו הדיינים ויש מי שהורה שהוא נותן קנס קצוב והוא י' זהובים וכן הורו שכל המונע הבעלים מלעשות מצות עשה שהם ראויים לעשותה וקדם אחר ועשאה משלם לבעלים י' זהובים (היה לו בן למול ובא אחר ומלו חייב ליתן לו י' זהובים אבל נתנו לאחר לימול ובא אחר ומלו פטור) (רבי' ירוחם נל"א ח"ד) ובזמן הזה אין מגבין אותו אבל אם תפס לא מפקינן מיניה:
One who cuts down his fellow's tree, and one who prevents his fellow from performing a mitzvah; it contains one se'if. An ox that was standing to be killed because it damages people, and a tree standing to be cut down because it damages the public, and one went ahead and slaughtered this ox or cut down this tree without the owner's knowledge — he must pay the owner as the judges see fit, for he has deprived him of performing a mitzvah. And if he pleaded and said, "You told me to kill it and to cut it down," since it stood for that, he is exempt (but any other one who damages is not believed to say that he gave him permission) (Tur, se'if 3), even if he has a migo (a plea he could have made in which he would have been believed) to say "I did not damage", for instance where there are no witnesses that he damaged, for it is as a migo against a presumption, which is no migo (Mordechai and Nimukei Yosef, chapter "One who wounds"); but he is believed to say (I did not damage) (another reading: "You told me", etc.) by a migo that what I damaged was not yours but was mine (Mordechai there). And likewise one who slaughtered a wild animal or a bird, and another came and covered the blood without the slaughterer's knowledge, must give as the judges see fit. And there is one who ruled that he gives a fixed fine, and it is ten gold pieces. And likewise they ruled that whoever prevents the owner from performing a positive commandment that he is fit to perform, and another went ahead and performed it, pays the owner ten gold pieces (if he had a son to circumcise and another came and circumcised him, he must give him ten gold pieces; but if he gave him to another to be circumcised and another came and circumcised him, he is exempt) (Rabbeinu Yerucham, netiv 31, part 4). And nowadays they do not collect it; but if he seized, we do not take it out of his hand.
