דין חמשה שישבו על ספסל אחד. ובו סעיף אחד: חמשה שישבו על הכסא ולא נשבר ובא אחרון וישב עליו ונסמך עליהם ולא הניחם לעמוד ונשבר אע"פ שהיה ראוי לישבר בהם קודם (שישב) הואיל וקרב שבירתו האחרון חייב שהרי אומרים לו אילו לא נסמכת (עליו) [עלינו] היינו עומדים קודם שישבר ואם ישבו כאחד ונשבר כולם חייבים וכן כל כיוצא בזה: הגה וי"א דסתם ספסל היא שאולה לסתם בני אדם ואם נשברה תחתיהן הוי כמתה מחמת מלאכה ופטורים מלשלם (טור ס"ב בשם הרא"ש תוס' פ"ק דב"ק) אא"כ היושבים הם משונים ושמנים וכבדים משאר בני אדם אז אם ישבו עליה ביחד ונשברה תחתיהן כולן חייבים לשלם ואם ישבו בזה אחר זה אם לא היתה נשברת בלא ישיבת האחרון הוא לבד חייב לשלם ואם היתה נשברת בלא האחרון הוא פטור ואם לא היתה נשברת רק תוך ב' שעות ועמו נשברה תוך שעה אז רואין אם סמך עליהן ומנען לעמוד הוא לבד חייב לשלם ואם לאו כולן חייבין (הכל בטור בשם הרא"ש):
The law of five who sat on one bench; it contains one se'if. Five who sat on the chair, and it did not break, and a last one came and sat on it and leaned on them and did not let them stand up, and it broke — even though it was fit to break with them before (he sat), since the last one brought its breaking near, he is liable; for they say to him: had you not leaned on us, we would have stood up before it broke. And if they sat at once and it broke, all of them are liable; and likewise in every similar case. Hagah [Rema]: And some say that a bench without specification is lent to people without specification, and if it broke under them it is as though it died from the work, and they are exempt from paying (Tur, se'if 2, in the name of the Rosh; the Tosafot, the first chapter of Bava Kamma) — unless those sitting are unusual, fat and heavy beyond other people; then, if they sat on it together and it broke under them, all of them are obliged to pay; and if they sat one after another — if it would not have broken without the last one's sitting, he alone is obliged to pay; and if it would have broken without the last one, he is exempt; and if it would have broken only within two hours, and with him it broke within one hour, then they see: if he leaned on them and prevented them from standing, he alone is obliged to pay; and if not, all of them are liable (all this is in the Tur in the name of the Rosh).
