Se’if 1א׳

האומר לחבירו קרע כסותי או של חבירי או רודף או נרדף ששיברו כלים. ובו ד סעיפים: האומר לחבירו קרע את כסותי שבר את כדי ע"מ שאתה פטור ה"ז פטור (וי"א אפי' לא ע"מ לפטור בפי' אלא שא"ל דברים שמשמעו כך כגון שא"ל שבור כדי וא"ל המזיק ע"מ לפטו' וא"ל הניזק לא יש לנו לומר דבתמיה קאמר לו ופטור) (טור ס"ב בשם הרא"ש) ואם לא אמר לו ע"מ שאתה פטור ה"ז חייב אע"פ שהרשהו להשחית בד"א כשבאו הכלים לידו תחל' בתורת שמיר' כגון שהיו שאולים או מופקדים אצלו אבל אם לא באו לידו בתורת שמיר' כיון שאמר לו קח כלי זה ושברו בגד זה וקרעו ועשה כן ה"ז פטור אע"פ שלא אמר לו ע"מ שאתה פטור (וע"ל עוד סי' שפ"ב מדינין אלו האומר לחבירו זרוק מנה לים ואתחייב אני לך י"א דחייב וי"א דפטור) (ר"ן פ"ק דקידושין ב' הדעות):

1. One who tells another "tear my garments, break my vessel, on the condition that you are exempt"- he is exempt (and there are those who say that even if he did not say "on condition that" explicitly, rather that he said words of similar meaning, for example if he said to him "break my vessel" and the damager said "on condition that I am exempt" and the one who suffered damage said "no" we can say that he said so sarcastically, and he is exempt). And if he did not say to him "on condition that you are exempt" then he is liable, even though he gave him permission to destroy. When is this true? When the items first came into his hand to be guarded, in that they had been lent or given for safekeeping. But if they did not come to be guarded, for example, if he said "take this vessel and break it, take this garment and tear it" and he did it, behold he is exempt, even though he did not say "on condition that you are exempt."

Se’if 2ב׳

האומר לחבירו שבר כליו של פלוני ע"מ שאתה פטור ושברו ה"ז חייב ואע"פ שהעושה הוא חייב לשלם הרי זה האומר לו שותפו בעון ורשע הוא שהרי הכשיל עור וחזק ידי עוברי עבירה:

One who says to his fellow, "Break so-and-so's vessels, on condition that you are exempt", and he broke them — he is liable; and even though the one who does it is obliged to pay, this one who told him is his partner in sin, and he is wicked, for he has put a stumbling-block before the blind and strengthened the hands of transgressors.

Se’if 3ג׳

רודף שהיה רודף אחר חבירו להרגו או אחר אחת מהעריות לאונסה ושבר כלים בין של נרדף בין של כל אדם פטור שהרי הוא מתחייב בנפשו שכיון שרדף התיר עצמו למיתה ולכן פטור מהתשלומין ואם הנרדף שבר כלים של רודף פטור שלא יהא ממונו חמור מגופו ואם היו של אדם אחר חייב שהמציל עצמו בממון חבירו חייב (וע"ל סי' שנ"ט ס"ד) ואחד שרדף אחר הרודף להציל את הנרדף ושבר כלים בין של רודף בין של כל אדם פטור כדי שלא יבואו מלימנע מלהציל את הנרדף:

A pursuer who was pursuing his fellow to kill him, or pursuing one of the forbidden women to violate her, and broke vessels — whether of the pursued or of anyone — is exempt; for he is liable with his life, since once he pursued he made himself liable to death, and therefore he is exempt from the payments. And if the pursued broke the pursuer's vessels, he is exempt, so that the pursuer's property should not be more stringent than his body; and if they were another person's, he is liable, for one who saves himself with his fellow's property is liable (and see above, siman 359, se'if 4). And one who pursued after the pursuer to save the pursued, and broke vessels — whether of the pursuer or of anyone — is exempt, so that people should not come to hold back from saving the pursued.
