Se’if 1א׳
היורד לשדה חבירו או לתוך חורבתו ונטעו או בנאו. ובו ט סעיפים: היורד לתוך שדה חבירו שלא ברשות ונטעה אם היתה שדה העשויה ליטע אומדין כמה אדם רוצה ליתן בשדה זו לנוטעה ונוטל מבעל השדה ואם אינה עשויה ליטע שמין לו וידו על התחתונה: הגה סתם כרם עשוי ליטע (ריב"ש סי' תתקט"ו) העושה טובה לחבירו שלא ברשות ע' לעיל סי' רס"ד וכן הלומד עם בן חבירו בלא דעת האב ע"ל סי' של"ה ס"א:
One who goes down into his fellow's field or into his ruin, and planted it or built it; it contains nine se'ifim. One who goes down into his fellow's field without permission and planted it: if it was a field made to be planted, they estimate how much a person would want to give for this field to plant it, and he takes it from the owner of the field; and if it is not made to be planted, they appraise it for him, and he has the lower hand. Hagah [Rema]: A vineyard without specification is made to be planted (Rivash, siman 915). One who does a favour for his fellow without permission — see above, siman 264; and likewise one who teaches his fellow's son without the father's knowledge — see above, siman 335, se'if 1.
Se’if 2ב׳
אמר ליה בעל השדה עקור אילנך ולך שומעין לו אבל אם אמר הנוטע הריני עוקר אילני אין שומעין לו מפני שמכחיש הארץ:
If the owner of the field said to him, "Uproot your trees and go", they listen to him; but if the planter said, "I am uprooting my trees", they do not listen to him, because he impoverishes the land.
Se’if 3ג׳
היורד לתוך שדה חבירו שלא ברשות ונטע או בנה ואח"כ בא בעל השדה והשלים הבנין או ששמר הנטיעות וכיוצא באלו הדברים שמראה שדעתו נוטה למה שעשה זה וברצונו בא הדבר שמין וידו על העליונה: הגה מיהו אם א"ל תחלה עקור אילנך ולך יכול בעל האילן לעשות אע"פ שחוזר בעל השדה אח"כ (נ"י פ' השואל):
One who goes down into his fellow's field without permission and planted or built, and afterwards the owner of the field came and completed the building, or guarded the plantings, and similar things that show that his mind inclines to what this one did, and that the matter came about with his consent — they appraise it, and he has the upper hand. Hagah [Rema]: However, if he first said to him, "Uproot your trees and go", the owner of the trees can do so, even though the owner of the field retracts afterwards (Nimukei Yosef, chapter "One who borrows").
