Se’if 1א׳
מכרה הגזלן וחזר וקנאה מהנגזל או נתנה לו במתנה. ובו ו סעיפים: הגוזל שדה ומכרה או נתנה לאחר שאין מעשיו כלום כמו שנתבאר אם אחר כך קנאה הגזלן מהנגזל נתקימה ביד הלוקח מהגזלן או ביד המקבל המתנה ממנו שמפני זה טרח הגזלן לקנותה כדי לעמוד בנאמנותו לפיכך אם לא קנאה עד שתבע הלוקח את הגזלן כגון שמכר לו השדה שאינה שלו ונתחייב לשלם והתחיל ב"ד להכריז על נכסי הגזלן כדי להגבות מהם ללוקח ואח"כ קנאה הגזלן מהנגזל לא נתקיימה ביד הלוקח ויכול הגזלן עצמו או יורשיו לתת לו מעותיו ולהוציאה מידו:
If the robber sold it and then bought it from the one robbed, or the one robbed gave it to him as a gift; it contains six se'ifim. One who robs a field and sold it, or gave it to another — his acts are nothing, as was explained. If afterwards the robber bought it from the one robbed, it stands in the hand of the one who bought from the robber, or in the hand of the one who received the gift from him; for it was on this account that the robber troubled to buy it, so as to keep faith. Therefore, if he did not buy it until the purchaser claimed from the robber — for example, he sold him the field that is not his and was obliged to pay, and the court began to announce the robber's property in order to collect from it for the purchaser — and afterwards the robber bought it from the one robbed, it does not stand in the purchaser's hand, and the robber himself or his heirs can give him his money and take it out of his hand.

לקחה הגזלן מהנגזל אחר שמכרה כשהיא גזולה וחזר ומכרה לאחר או נתנה במתנה או הורישה הרי גילה דעתו שאינו רוצה להעמידה ביד זה שלקחה ממנו כשהיתה גזולה וכן אם נפלה לגזלן בירושה לא נתקיימה ביד הלוקח: הגה ויש חולקין וס"ל דאם מכרה או נתנה לאחר שקנאה הלוקח ראשון קנה אבל אם מכרה או נתנה קודם שקנאה לא קנה לוקח ראשון (טור ס"ב וב"י בשם רש"י) וכל זה לא מיירי אלא בשלא הכיר בה שהיא גזולה וקנאה אבל אם הכיר בה וקנאה לא קנה לוקח (המגיד פ"ט דגזילה ור"ן ונ"י פ"ק דב"מ):
If the robber bought it from the one robbed after he had sold it while it was stolen, and then sold it to another, or gave it as a gift, or bequeathed it — he has revealed his mind that he does not want to establish it in the hand of this one who bought it from him while it was stolen. And likewise, if it fell to the robber by inheritance, it does not stand in the purchaser's hand. Hagah [Rema]: And some disagree and hold that if he sold it or gave it to another after he bought it, the first purchaser has acquired; but if he sold it or gave it before he bought it, the first purchaser has not acquired (Tur, se'if 2, and Beit Yosef in the name of Rashi). And all this speaks only where the purchaser did not recognise that it was stolen when he bought it; but if he recognised it and bought it, the purchaser has not acquired (the Maggid, chapter 9 of the Laws of Robbery, and the Ran and Nimukei Yosef, the first chapter of Bava Metzia).
Se’if 3ג׳
גבאה הגזלן בחובו אם יש לנגזל קרקע אחרת וא"ל הגזלן זו אני גובה בחובי ה"ז מתכוין להעמידה ביד הלוקח ואם אין לנגזל קרקע אלא זו לגבות חובו הוא שנתכוון:
If the robber collected it for his debt: if the one robbed has other land, and the robber said to him, "This I am collecting for my debt", he intends to establish it in the purchaser's hand; and if the one robbed has no land but this, it is to collect his debt that he intended.
