Se’if 1א׳
קרקע אינה נגזלת אפי' נתייאשו הבעלים. ובו ד סעיפים: קרקע אינה נגזלת לעולם אלא ברשות בעליה עומדת אפילו נמכרה לאלף זה אחר זה ונתייאשו הבעלים ה"ז חוזרת לנגזל בלא דמים וכל מי שיצא' מתחת ידו חוזר על זה שמכרה לו וחוזר המוכר השני על המוכר הראשון עד שיחזיר הלוקח מהגזלן על הגזלן ויטול ממנו (וע"ל סי' רל"ו אם לקחה מעכו"ם גזלן מה דינו):
Land cannot be robbed, even if the owner despaired; it contains four se'ifim. Land can never be robbed; rather, it stands in its owner's domain. Even if it was sold to a thousand, one after another, and the owner despaired, it returns to the one robbed without payment; and each one from under whose hand it goes out goes back against the one who sold it to him, and the second seller goes back against the first seller, until the one who bought from the robber goes back against the robber and takes from him (and see above, siman 236, what the law is if he bought it from a gentile robber).

לפיכך אם אירע בה קלקול הבא מאיליו כגון ששטפה נהר אין אחריות ההפסד על הגזלן שבחזקת בעליה עומדת ואומר לו הרי שלך לפניך אבל אם הפסידה הגזלן בידיו כגון שחפר בה בורות שיחין ומערות או שקצץ את האילנות ושחת את המעיינות והרס את הבנין חייב להעמיד לו בית או שדה כמו שהיו בשעת הגזילה או ישלם דמי מה שהפסיד: הגה וכשם שהקרקע בחזקת הנגזל שיכול לומר הרי שלך לפניך כן הוא ברשותו לטובתו דאע"ג דלגבי מטלטלין אינו משלם אלא כשעת גזילה גבי קרקע אינו כן אלא אם נשתמש ואכל פירותיה צריך לשלם מה שנהנה ממנה (טור):
Therefore, if damage befell it that comes of itself — for example, a river flooded it — the responsibility for the loss is not on the robber, for it stands in the presumptive possession of its owner, and he says to him: here is yours before you. But if the robber ruined it with his hands — for example, he dug pits, ditches and caves in it, or cut down the trees, or spoiled the springs, or tore down the building — he is obliged to set up for him a house or a field as they were at the time of the robbery, or pay the value of what he ruined. Hagah [Rema]: And just as the land is in the presumptive possession of the one robbed, so that he can say, "Here is yours before you", so it is in his domain to his advantage; for even though with movables he pays only as at the time of the robbery, with land it is not so; rather, if he used it and ate its produce, he must pay what he benefited from it (Tur).

גזל שדה ונטלוה מציקין בכח המלך אם מכת מדינה היא כגון שלקח המלך שדות או בתים של כל אנשי המדינה אומר לו הרי שלך לפניך ואם מחמת הגזלן נלקחה חייב להעמיד לו שדה אחרת:
If he robbed a field and oppressors took it by the power of the king — if it is a regional calamity, for example the king took the fields or the houses of all the people of the country, he says to him: here is yours before you; and if it was taken on account of the robber, he is obliged to set up for him another field.
