Se’if 1א׳

דברים שהם גזל מדבריהם כגון מפריחי יונים והמשחקים בקוביא. ובו ז סעיפים: יש דברים שאסרו חכמים משום גזל והעובר עליהם הרי זה גזלן מדבריהם מפריחי יונים ומשחקים בקוביא מפריחי יונים כיצד לא יפריח אדם בתוך היישוב שהרי לוקח ממון אחרים שלא כדין מפני שמשלח זכר ויביא נקיבה משובך אחר או נקבה ותביא זכר ולא יונים בלבד אלא כל העושה כזה בשאר עופות או חיה או בהמה ה"ז גזלן מדבריהם:

Things that are robbery by their words, such as those who fly pigeons and those who play with dice; it contains seven se'ifim. There are things that the Sages forbade on account of robbery, and one who transgresses them is a robber by their words: those who fly pigeons and those who play with dice. Those who fly pigeons — how so? A man shall not fly pigeons within a settled place, for he takes the money of others unlawfully, because he sends out a male and it brings a female from another dovecote, or a female and it brings a male. And not pigeons alone, but whoever does such a thing with other birds, or a wild animal, or a domestic animal, is a robber by their words.

Se’if 2ב׳

המשחקים בקוביא כיצד אלו שמשחקים בעצים או בצרורות או בעצמות ועושים תנאי ביניהם שכל הנוצח את חבירו באותו שחוק יקח כך וכך וכן המשחקים בבהמה או בחיה או בעופות ועושים תנאי שכל שתנצח בהמתו או תרוץ יותר יקח מחבירו כך וכך וכן כל כיוצא בדברים אלו הכל אסור וגזל מדבריהם הוא:

Those who play with dice — how so? These are those who play with pieces of wood, or with pebbles, or with bones, and make a condition between them that whoever beats his fellow at that game takes such-and-such; and likewise those who play with a domestic animal, or a wild animal, or birds, and make a condition that whoever's animal wins, or runs faster, takes such-and-such from his fellow; and likewise everything similar to these things — all of it is forbidden, and it is robbery by their words.

Se’if 3ג׳

(טור הביאו בס"ו) יש מי שאומר שהמשחק בקוביא עם העכו"ם אין בו משום גזל אבל יש בו איסור עוסק בדברים בטלים שאין ראוי לאדם שיעסוק כל ימיו אלא בדברי חכמה ויישובו של עולם וחלקו עליו לומר שאינו פסול אלא א"כ אין לו אומנות אחרת: הגה אבל אם יש לו אומנות אחרת אפי' משחק עם ישראל אינו פסול (טור) וע"ל סי' ר"ז סי' י"ג וכבר פשט המנהג כסברא האחרונה לשחוק בקוביא ואין פסול אלא מי שאין לו אומנות אלא הוא ואם שחק עמו באמנה אם חייב לשלם ע"ל סי' ר"ז ושם:

(Tur brings it in se'if 6.) There is one who says that one who plays dice with a gentile has no element of robbery in it, but it has the prohibition of occupying oneself with idle things, for it is not fitting for a man to occupy himself all his days with anything but matters of wisdom and the settlement of the world; and they disagreed with him, saying that he is disqualified only if he has no other craft. Hagah [Rema]: But if he has another craft, even if he plays with an Israelite he is not disqualified (Tur); and see above, siman 207, se'if 13. And the practice has already spread according to the latter opinion, to play with dice, and only one who has no craft but it is disqualified. And if he played with him on trust, whether he is obliged to pay — see above, siman 207, and there.
