Se’if 1א׳

גזלן שבא להחזיר את הגזילה והגוזל את אביו. ובו ו סעיפים: הגוזל את חבירו אע"פ שכפר בו הואיל ולא נשבע אם חזר והודה אינו חייב לרדוף אחר הבעלים להחזיר להם אלא יהא בידו עד שיבואו (ויודיע אותם) (טור ס"א) ויטלו את שלהם אבל אם נשבע על שוה פרוטה ומעלה חייב לרדוף אחר הבעלים עד שיחזיר להם אפי' הם באיי הים מפני שכבר נתיאשו מאחר שנשבע ואינם באים עוד לתובעו:

A robber who comes to return the robbed thing; and one who robs his father; it contains six se'ifim. One who robs his fellow — even though he denied it to him, since he did not swear, if he then went back and admitted, he need not pursue the owner to return it to him; rather, it shall remain in his hand until the owner comes (and he shall inform him) (Tur, se'if 1) and takes what is his. But if he swore over a perutah's worth or more, he is obliged to pursue the owner until he returns it to him, even if he is in the islands of the sea, because the owner has already despaired, since the robber swore, and will not come again to claim from him.

Se’if 2ב׳

אפי' החזיר הגזילה כולה חוץ משוה פרוטה חייב הגזלן להוליכה אחר הנגזל ולא יתן לא לבנו של נגזל ולא לשלוחו אא"כ עשה הנגזל השליח בעדים וכן אם עשו ב"ד שליח בעדים ונתן לו יצא ואצ"ל אם נתן לב"ד שיצא:

Even if he returned all of the robbed thing except a perutah's worth, the robber is obliged to carry it after the one robbed; and he shall not give it to the son of the one robbed, nor to his agent, unless the one robbed appointed the agent before witnesses. And likewise, if the court appointed an agent before witnesses and he gave it to him, he has discharged his obligation; and needless to say, if he gave it to the court, he has discharged it.

Se’if 3ג׳

החזיר לו כל הגזיל' או שמחל לו עליה חוץ מפחות שוה פרוטה אינו צריך להוליך אחריו אלא יבא הנגזל ויטול השאר ואע"פ שהגזילה עצמה קיימת אין חוששין שמא תתייקר ונמצא הנשאר שוה פרוטה:

If he returned to him all of the robbed thing, or the other forgave him for it, except for less than a perutah's worth, he need not carry it after him; rather, the one robbed shall come and take the rest. And even though the robbed thing itself is in existence, we are not concerned lest it rise in price and it turn out that what remains is worth a perutah.

Se’if 4ד׳

מת הנגזל כשבא הגזלן לעשות תשובה יחזיר ליורשיו אם הגזילה בעין ואם אינה בעין [ או שנשתנית] יחזיר להם דמיה כשם שהיה מחזיר למורישם:

If the one robbed died when the robber came to repent, he shall return it to his heirs, if the robbed thing is in existence; and if it is not in existence, or it has changed, he shall return its value to them, just as he would have returned it to the one they inherit from.

Se’if 5ה׳

(טור הביאו בס"ח) הגוזל את אביו ונשבע לו ומת האב אם אין הגזילה קיימת או נשתנית עושה חשבון עם אחיו על הקרן ואם הגזיל' קיימת חייב להוצי' הגזיל' עצמה מתחת ידו לפיכך נותן הגזילה לאחיו ועושה עמהם חשבון (וי"א דאינו נוטל כלום נגד הגזילה ואם הוא עני ולא יכול לוותר חלקו לוה מאחרים והם באים ונפרעים מחלקו) (טור ס"ה) ואם אין לו אחים שנמצא זה הגזלן לבדו הוא היורש מוציא הגזילה מתחת ידו לבניו ואם אין בנים לזה הבן הגזלן נותנם לבעל חובו בהלואתו או לצדק' הואיל ויצאה גזילה עצמה מתחת ידו נפטר אע"פ שנתנ' מתנה או פרעה בחובו והוא שיודיעם ויאמר זה גזל אבא (ויש חולקין וסבירא להו דאם אין לגזלן (אחים) נותן לאחי אביו) (טור):

(Tur brings it in se'if 8.) One who robs his father and swore to him, and the father died: if the robbed thing is not in existence, or it has changed, he makes a reckoning with his brothers over the principal; and if the robbed thing is in existence, he is obliged to remove the robbed thing itself from under his hand; therefore he gives the robbed thing to his brothers and makes a reckoning with them (and some say that he takes nothing against the robbed thing; and if he is poor and cannot forgo his share, he borrows from others, and they come and are repaid from his share) (Tur, se'if 5). And if he has no brothers, so that this robber turns out to be the sole heir, he removes the robbed thing from under his hand to his sons; and if this son, the robber, has no sons, he gives them to his creditor for his loan, or to charity. Since the robbed thing itself has left his hand, he is released, even though he gave it as a gift or paid his debt with it; and that is provided that he informs them and says, "This my father robbed" (and some disagree and hold that if the robber has no (brothers), he gives it to his father's brothers) (Tur).
