Se’if 1א׳

גזלן שבא לעשות תשובה אם מקבלין ממנו. ובו ד סעיפים: גזלן מפורסם (שעסקיו בכך ותשובתו קשה) הבא לעשות תשובה מעצמו אם אין הגזילה קיימת אין מקבלין ממנו כדי שלא ימנע מלעשות תשובה ואם רצה לצאת ידי שמים והחזיר אין מוחין ביד הנגזל מלקבלו: הגה וכן אם לא בא לעשות תשובה מעצמו רק שהנגזל צריך לתבעו מחייבים אותו להחזיר (טור ס"א):

A Robber Who Comes to Repent, Whether We Accept from Them; this has four sections: A well-known robber (who was thoroughly engaged in this and for whom repentance is difficult) who comes on their own to repent: if the robbed item still exists, one should not accept it, in order not to prevent them from repenting, but if [the robber] wanted to fulfill Heavenly standards and returned it, we do not prevent the person who was robbed from accepting it. Rema’s gloss: Similarly, if [the robber] did not come on their own to repent, but was sued by the person they robbed, then we do require them to return it.

Se’if 2ב׳

הרועים והגבאים והמוכסים תשובתן קשה מפני שגזלו את הרבים ואינם יודעים למי יחזרו לפיכך יעשו בו צרכי רבים כגון בורות שיחין ומערות: הגה גזלן שהחזיר אם צריך דעת בעלים דינו כמו בגנב (טור סג) וע' לעיל סי' שנ"ה):

For shepherds, tax collectors, and customs collectors, repentance is difficult, because they robbed the masses and do not know to whom to make restitution. Therefore, they should use it for public necessities, such as wells, ditches, and caves.

Se’if 3ג׳

היה כלי ביד בנו של בע"ה או ביד עבדו ולקחו אחד מהם ונשתמש בו ה"ז שואל שלא מדעת ונעשה ברשותו ונתחייב באונסין עד שיחזירנו לבעלים לפיכך אם החזירו לקטן שהיה בידו ואבד ממנו או נשבר חייב לשלם:

If a vessel was in the hand of the householder's son or in the hand of his slave, and someone took it from one of them and used it — this is one who borrows without the owner's knowledge, and it comes into his domain, and he becomes liable for mishaps until he returns it to the owner; therefore, if he returned it to the minor in whose hand it had been, and it was lost from him or broke, he is obliged to pay.
