Se’if 1א׳
הגוזל ואינו יודע ממי גזל. ובו ב סעיפים: הגוזל אחד מחמשה ואינו יודע לאיזה מהם גזל כל אחד מהם אומר אותי גזל אע"פ שאין שם עדים שגזל הרי כל אחד מהם נשבע שזה גזלו ומשלם גזילה לכל אחד ואחד:
One who robbed and does not know from whom he robbed; it contains two se'ifim. One who robbed one of five people and does not know which of them he robbed, and each of them says, "He robbed me" — even though there are no witnesses there that he robbed, each of them swears that this man robbed him, and he pays the robbed thing to each and every one.
Se’if 2ב׳
אמר לשנים גזלתי את אחד מכם ואיני יודע איזהו אינו נותן אלא מנה והם חולקים ביניהם מאחר שהם לא היו יודעים שנגזלו אלא על פיו ועם כל זה אם בא לצאת ידי שמים חייב לשלם כל הגזילה לכל אחד ואחד אבל שנים שתבעו את אחד וכל א' מהם א"ל גזלתני מנה והוא משיב אמת שגזלתי את אחד מכם מנה אבל איני יודע לאיזה מכם חייב לשלם לכל אחד מהם מנה: הגה וכן אם גזל לשנים לאחד מנה ולאחד מאתים וכל אחד מהם תובעו מאתים והוא אינו יודע למי גזל מאתים נותן לכל אחד מאתים גזל לאחד ואינו יודע אם החזיר לו אע"פ שאין תובע אותו חייב לשלם לו אם בא לצאת ידי שמים אבל אם אמר לאחד איני יודע אם גזלתיך אם לאו אפי' בבא לצאת ידי שמים אינו חייב לשלם לו (טור):
If he said to two, "I robbed one of you, and I do not know which", he gives only a maneh, and they divide it between them, since they would not have known that they were robbed except by his word; and with all this, if he comes to fulfil his duty to Heaven, he is obliged to pay the whole robbed thing to each and every one. But two who claimed from one, and each of them said to him, "You robbed me of a maneh", and he answers, "It is true that I robbed one of you of a maneh, but I do not know which of you" — he is obliged to pay each of them a maneh. Hagah [Rema]: And likewise, if he robbed two — one of a maneh and one of two hundred — and each of them claims two hundred from him, and he does not know whom he robbed of two hundred, he gives each two hundred. If he robbed one and does not know whether he returned it to him, even though the other does not claim from him, he is obliged to pay him if he comes to fulfil his duty to Heaven; but if he said to one, "I do not know whether I robbed you or not", even when he comes to fulfil his duty to Heaven he is not obliged to pay him (Tur).
