Se’if 1א׳
הנכנס בבית פלוני והוציא כלים או חטף מידו זהובים. ובו ט סעיפים: מי שהעידו עליו שנכנס לביתו של פלוני בפניו ונטל כלים ואין ידוע כמה נטל נתבארו משפטיו בסי' צ':
One who entered so-and-so's house and brought out vessels, or snatched gold coins from his hand; it contains nine se'ifim. One about whom they testified that he entered so-and-so's house in his presence and took vessels, and it is not known how much he took — its laws were explained in siman 90.
Se’if 2ב׳
ראוהו עדים שנכנס לתוך בית חבירו שלא בפני ב"ה ונטל משם כלים אע"פ שהוציאם מגולים ואע"פ שהבעל הבית הזה עשוי למכור את כליו אם טען ואמר דרך גזל לקחם והלה אומר ברשותך באתי ואתה מכרתם לי או נתתם לי או בחוב שיש לי אצלך תפסתים אינו נאמן שכל הנכנס לבית חבירו שלא בפניו ונטל כלים משם והוציאם בפני עדים ה"ז בחזקת גזלן לפיכך מחזיר הכלים לב"ה ואין כאן שבועה שהרי העדים ראו מה גזל ואחר שיחזיר חוזר ותובע את בע"ה בכל מה שיטעון והדין ביניהם:
If witnesses saw him enter his fellow's house not in the householder's presence and take vessels from there — even though he brought them out uncovered, and even though this householder is accustomed to sell his vessels — if he pleaded and said, "He took them by way of robbery", and the other says, "I came with your permission, and you sold them to me", or "you gave them to me", or "I seized them for a debt that I have with you" — he is not believed; for whoever enters his fellow's house not in his presence and took vessels from there and brought them out before witnesses is in the presumption of a robber. Therefore he returns the vessels to the householder, and there is no oath here, for the witnesses saw what he robbed; and after he returns them, he goes back and claims from the householder whatever he may plead, and the law is between them.

וכן אם היה שם עד אחד בלבד ובעל הבית טוען שגזל הוא כלי זה בידו והלה אומר לקוח הוא בידי או בחוב גביתיו או שלי היה ופקדון הוא אצלך ה"ז חייב להחזיר הכלי לבעליו בלא שבועה שאילו היה שני עדים היה חייב לשלם ועכשיו שאין שם אלא עד אחד חייב שבועה ואינו יכול לישבע שהרי אינו מכחיש את העד וכל המחוייב שבועה ואינו יכול לישבע משלם לפיכך אם כפר ואמר לא נכנסתי לביתו ולא נטלתי כלום הואיל ואין שם אלא עד אחד והוא מכחישו הרי זה נשבע שבועת התורה שלא לקח מביתו כלום ונפטר (ע"ל סי' צ' ס"ג):
And likewise, if there was only one witness there, and the householder pleads that this vessel in his hand he robbed, and the other says, "It is bought in my hand", or "I collected it for a debt", or "It was mine, and it was a deposit with you" — he is obliged to return the vessel to its owner without an oath; for had there been two witnesses he would have been obliged to pay, and now that there is only one witness there he is obliged to take an oath, and he cannot swear, for he does not contradict the witness; and whoever is obliged to take an oath and cannot swear pays. Therefore, if he denied and said, "I did not enter his house and I took nothing", since there is only one witness there and he contradicts him, he swears an oath by Torah law that he took nothing from his house, and is exempt (see above, siman 90, se'if 3).
