Se’if 1א׳

הגוזל בהמ' ועבדים והזקינו והדר בחצר חבירו שלא מדעתו. ובו יא סעיפים: גזל בהמ' והזקינ' או כחשה כחש שאינו יכול לחזור כגון חלאים שאין להם רפואות תעל' או שגזל מטבע ונסדק או פסלו המלך (וי"א דמטבע אפי' פסלה המלך אומר לו הרי שלך לפניך) (טור ס"א בשם הרא"ש) או שגזל פירות והרקיבו כולם או שגזל יין והחמיץ ה"ז כמו שגזל כלי ושברו ומשלם כשעת הגזיל' אבל אם גזל בהמות וכחשו כחש שאפשר לחזור או שגזל עבדים והזקינו או שגזל מטבע ונפסל במדינ' זו והרי הוא יוצא במדינ' אחרת או שגזל פירות והרקיבו מקצתם או תרומ' ונטמאת או שגזל חמץ ועבר עליו הפסח או בהמה ונעבד' בה עביר' או נפסלה מליקרב או שהית' יוצאת ליסקל אומר לו הרי שלך לפניך ומחזיר אותה בעצמ':

One who robs an animal or slaves and they grew old; and one who lives in his fellow's courtyard without his knowledge; it contains eleven se'ifim. If he robbed an animal and it grew old, or grew lean with a leanness from which it cannot recover — such as illnesses for which there is no healing cure; or he robbed a coin and it cracked, or the king invalidated it (and some say that with a coin, even if the king invalidated it, he says to him: here is yours before you) (Tur, se'if 1, in the name of the Rosh); or he robbed produce and all of it rotted; or he robbed wine and it turned sour — this is as though he robbed a vessel and broke it, and he pays as at the time of the robbery. But if he robbed animals and they grew lean with a leanness from which it is possible to recover; or he robbed slaves and they grew old; or he robbed a coin and it was invalidated in this country but it is current in another country; or he robbed produce and part of it rotted; or terumah, and it became impure; or he robbed leaven and Passover passed over it; or an animal, and a transgression was committed with it, or it became unfit to be offered, or it was going out to be stoned — he says to him: here is yours before you, and he returns it itself.

Se’if 2ב׳

במה דברים אמורים כשהחזיר הגזיל' אבל אם נשרפ' הגזיל' או אבדה אחר שנאסר' בהנא' חייב להחזיר לו דמיה כשעת הגזיל':

When does this apply? When he returned the robbed thing; but if the robbed thing was burnt or lost after it became forbidden for benefit, he is obliged to return him its value as at the time of the robbery.

Se’if 3ג׳

הגוזל בהמ' ונשא עליה משא או רכב עליה או חרש או דש בה וכיוצא בזה והחזיר' לבעליה אף ע"פ שעבר בל"ת אינו חייב לשלם כלום שהרי לא הפסיד' ולא הכחיש' ואם הוחזק אדם זה לגזול או לעשוק או לעשות מעשים אלו פעם אחר פעם קונסין אותו ואפי' בח"ל ושמין השכר או השבח שהשביח בבהמ' ומשלם לנגזל:

One who robs an animal and loaded a burden on it, or rode on it, or ploughed or threshed with it, and the like, and returned it to its owner — even though he transgressed a negative commandment, he is not obliged to pay anything, for he caused it no loss and did not make it lean. And if this man is established as one who robs, or oppresses, or does such deeds time after time, they fine him — even outside the Land — and appraise the hire, or the gain that he gained with the animal, and he pays the one robbed.
