Se’if 1א׳

השביחה הגזילה ביד הגזלן ממילא. ובו יג סעיפים: הגזילה שלא נשתנית אלא הרי היא כמו שהיתה אע"פ שנתיאשו הבעלים ממנה ואע"פ שמת הגזלן והרי היא ביד בניו הרי זו חוזרת לבעליה בעצמה ואם נשתנית ביד הגזלן אע"פ שעדיין לא נתיאשו הבעלים ממנה קנאה בשינוי ומשלם דמיה כשעת הגזיל':

If the robbed thing improved in the robber's hand of itself; it contains thirteen se'ifim. A robbed thing that has not changed, but is as it was — even though the owner has despaired of it, and even though the robber died and it is in his sons' hand — returns to its owner itself. And if it changed in the robber's hand, even though the owner has not yet despaired of it, he has acquired it by the change, and pays its value as at the time of the robbery.

Se’if 2ב׳

נתיאשו הבעלים ממנה ולא נשתנית קנה הגזלן כל השבח שהשביחו אחר יאוש ואינו משלם אלא כשעת הגזילה ודבר זה מדבריהם מפני תקנת השבים וכשמחזיר לו הגזילה שמין לו השבח ונוטל מן הנגזל:

If the owner despaired of it and it did not change, the robber has acquired all the improvement that it gained after despair (of recovery), and he pays only as at the time of the robbery; and this matter is from their words, on account of the ordinance for penitents. And when he returns the robbed thing to him, they appraise the improvement for him, and he takes it from the one robbed.

Se’if 3ג׳

מכרה הגזלן או נתנה במתנה אף ע"פ שלא נשתנית הגזיל' אינה חוזרת בעצמה מיד הלוקח הואיל ונתייאשו הבעלים בין לפני מכיר' ונתינה בין לאחר מכירה ונתינה קנאה הלוקח ביאוש ושינוי רשות (ויש חולקין ועיין לעיל סי' שנ"ג) (טור סי' שנ"ג בשם הרא"ש):

If the robber sold it or gave it as a gift, even though the robbed thing has not changed, it does not return itself from the hand of the purchaser, since the owner has despaired: whether before the sale and the giving or after the sale and the giving, the purchaser has acquired it by despair and a change of domain (and some disagree; and see above, siman 353) (Tur, siman 353, in the name of the Rosh).
