Se’if 1א׳
מצוה על הגזלן להשיב הגזילה ואם אין בה שוה פרוטה או נשתנית. ובו י סעיפים: כל הגוזל חייב להחזיר הגזילה עצמה שנא' והשיב את הגזילה אשר גזל ואם אבדה או נשתנית משלם דמיה בין שהודה מפי עצמו בין שבאו עליו עדים שגזל אפי' גזל קורה ובנאה בבירה גדולה הואיל ולא נשתנית דין תורה הוא שיהרוס כל הבנין ויחזר הקורה לבעלים אבל תקנו חכמים מפני תקנת השבים שיהיה נותן את דמיה ולא יפסיד הבנין אפי' גזל קורה ועשאה בסוכות החג ובא בעל הקורה ותובעה בתוך החג נותן לו את דמיה אבל אחר החג הואיל ולא נשתנית ולא בנאה בטיט מחזיר את הקורה עצמה: הגה גזל קרקע ובנה עליה בניינים גדולים צריך לסתור הכל ולהשיב קרקע לבעלים דלא עשו תקנת השבים בקרקע (ר' י נל"א ח"ו):
The mitzvah upon the robber to return the robbed thing; and if it is not worth a perutah, or it was changed; it contains ten se'ifim. Whoever robs is obliged to return the robbed thing itself, as it is said: "And he shall restore that which he took by robbery"; and if it was lost or changed, he pays its value — whether he admitted of his own accord, or witnesses came against him that he robbed. Even if he robbed a beam and built it into a great mansion — since it has not changed, the law of the Torah is that he must tear down the whole building and return the beam to its owner; but the Sages ordained, on account of the ordinance for penitents, that he should give its value and not lose the building. Even if he robbed a beam and made it part of a sukkah during the festival, and the owner of the beam came and claimed it during the festival, he gives him its value; but after the festival, since it has not changed and he did not build it in with mortar, he returns the beam itself. Hagah [Rema]: If he robbed land and built great buildings on it, he must tear everything down and return the land to its owner, for they did not make the ordinance for penitents with regard to land (Rabbeinu Yerucham, netiv 31, part 6).
Se’if 2ב׳
הגוזל פחות משוה פרוטה אע"פ שעבר אינו בתורת השבה:
One who robs less than a perutah's worth, even though he transgressed, does not come under the law of restoring.
Se’if 3ג׳
גזל ג' אגודות שוות שלשה פרוטות והוזלו והרי שלשתן שוות ב' פרוטות והחזיר לו שתים חייב להחזיר השלישית הואיל ובתחילתה היתה שוה פרוטה:
If he robbed three bundles worth three perutot, and they fell in price, so that the three of them are worth two perutot, and he returned two to him — he is obliged to return the third, since at the outset it was worth a perutah.
