Se’if 1א׳
אסור לקנות שום דבר מהגנב והקונה מגנב מפורסם או אינו מפורסם. ובו י סעיפים: אסור לקנות מהגנב החפץ שגנב ועון גדול הוא שהרי מחזיק ידי עוברי עבירה וגורם לו לגנוב גניבות אחרות שאם לא ימצא לוקח אינו גונב (וכן אסור לסייע לגנב בשום דבר כדי שיגנוב) (ב"י בשם ריב"ש סי' ק"ח):
It is forbidden to purchase a stolen object from a thief. Purchasing such an object is a grave sin as he is enabling sinners and causing him to steal again, for if he would not find customers he would not steal. (Likewise, it is forbidden to assist a thief with anything that enables him to steal)
Se’if 2ב׳
הגונב ומכר ולא נתייאשו הבעלים (וע"ל סימן שס"ח) ואח"כ הוכר הגנב ובאו עדים שזה החפץ שמכר פלוני הוא גנבו בפנינו חוזר החפץ לבעלים והבעלים נותנים ללוקח דמים שנתן לגנב מפני תקנת השוק והבעלים חוזרים ועושים דין עם הגנב ואם גנב מפורסם הוא לא עשו בו תקנת השוק (טור ס"ד בשם רי"ף ורמב"ם) ואין הבעלים נותנים ללוקח כלום אלא חוזר הלוקח ועושה דין עם הגנב ומוציא ממנו דמים שנתן לו: הגה וי"א דאף בגנב מפורסם עשו תקנת השוק וצריך להחזיר ללוקח מעותיו אא"כ ידע הלוקח שזה הדבר שקנה גנוב שאז צריך להחזיר בלא דמים (טור בשם הרא"ש ור"י) ואפילו הגנב (אין צריך) להחזיר לו מעותיו דודאי נתן לו לשם מתנה הואיל וידע שאינו שלו וקנאה (מרדכי פ' הגוזל בתרא) ואם אמר הלוקח לטובה נתכוונתי נאמן וצריך להחזיר לו מעותיו אפילו בגנב מפורסם לכ"ע (מרדכי ותוספות פ' הנ"ל והגהות מיימוני פ"ה דגניבה):
One who steals and sold it, and the owner had not despaired (and see below, siman 368), and afterwards the thief was recognised, and witnesses came, "This object that so-and-so sold — he stole it in our presence" — the object returns to the owner, and the owner gives the purchaser the price he gave the thief, because of the market ordinance, and the owner in turn goes to law with the thief. And if he is a notorious thief, they did not make the market ordinance for him (Tur, se'if 4, in the name of the Rif and the Rambam), and the owner gives the purchaser nothing; rather, the purchaser in turn goes to law with the thief and recovers from him the price he gave him. Hagah [Rema]: And some say that even with a notorious thief they made the market ordinance, and he must return the purchaser his money, unless the purchaser knew that this thing he bought was stolen, for then he must return it without the price (Tur in the name of the Rosh and the Ri); and even the thief (need not) return him his money, for he certainly gave it to him as a gift, since he knew that it was not his, and bought it (Mordechai, chapter "One who robs, the latter"). And if the purchaser said, "I intended it for good", he is believed, and he must return him his money even with a notorious thief, according to all opinions (Mordechai and the Tosafot, the chapter cited above, and Hagahot Maimoni, chapter 5 of the Laws of Theft).

נתיאשו הבעלים מהגניבה בין שנתיאשו ואח"כ מכר בין שנתיאשו אחר שמכר קנה לוקח ביאוש ושינוי [רשות] (וי"א דאם נתייאש לאחר שמכר לא קנה לוקח דאין יאוש ושינוי רשות קונה אלא אם נתייאש קודם שמכר (טור סי' שנ"ג בשם הרא"ש) וכן נ"ל להורות) (וע"ל סי' שס"ג) ואינו מחזיר הגניבה עצמה לבעליה אלא נותן להם הדמים אם לקח מגנב מפורסם או אינו נותן כלל לא חפץ ולא דמים אם לא היה זה המוכר גנב מפורסם: הגה פי' דהרי הבעלים צריכין ליתן ללוקח דמי המקח ומשום תקנת השוק ולכן המותר מדמי המקח צריך ליתן לו לפי סברא זו אלא דיש חולקין וסבירא להו דיאוש ושינוי רשות קונה לגמרי וא"צ ליתן לו הדמים (וע"ל סי' שנ"ג):
If the owner despaired of the stolen thing — whether they despaired and afterwards he sold it, or they despaired after he sold it — the purchaser acquires it by despair (of recovery) and change of domain (and some say that if he despaired after he sold, the purchaser has not acquired it, for despair and change of domain acquire only if he despaired before he sold) (Tur, siman 353, in the name of the Rosh) (and so it seems to me to rule) (and see below, siman 363); and he does not return the stolen thing itself to its owner, but gives them its value, if he bought from a notorious thief; or he gives nothing at all, neither the object nor its value, if this seller was not a notorious thief. Hagah [Rema]: That is, for the owner must give the purchaser the price of the purchase, and because of the market ordinance; and therefore what is left over from the price of the purchase he must give him, according to this view. But there are those who disagree and hold that despair and change of domain acquire completely, and he need not give him the price (and see above, siman 353).
