Se’if 1א׳
גנב שהחזיר הגניבה שלא מדעת הבעלים. ובו ג סעיפים: הגונב חפץ מבית חבירו והחזירו למקומו ולא ידעו הבעלים שהחזירו אם ידעו הבעלים שנגנב מהם אע"פ שהחזירו הגנב לא נפטר והוא באחריותו עד שידעו הבעלים כגון שימנה חפציו וימצאם שלמים ומיהו כשמנאם נפטר אע"פ שלא ידעו הבעלים בשעה שהחזירו לפיכך גנב לו מעות והבליעם לו בחשבון ונתנם לתוך כיסו אם יודע מנין המעות שלו יצא שאדם עשוי למשמש בו בכל שעה והרי מצא שהחזיר לו בכלל מעותיו אבל אם זרקן לכיסו שאין בו כלום לא יצא וחייב באחריות הגזילה עד שיודיענו שהחזיר לכיס פלוני ואם לא ידעו הבעלים שנגנב מהם מיד כשהחזירם למקומם יצא אע"פ שלא מנאום הבעלים:
A thief who returned the stolen thing without the owner's knowledge; it contains three se'ifim. One who steals an object from his fellow's house and returned it to its place, and the owner did not know that he returned it: if the owner knew that it had been stolen from him, even though the thief returned it, he is not quit, and it is at his risk until the owner knows — for example, that he counts his objects and finds them whole; and when he has counted them, he is quit, even though the owner did not know at the time he returned it. Therefore, if he stole money from him and slipped it back to him in a reckoning, and put it into his purse: if he knows the number of his coins, he has discharged his duty, for a person is apt to feel his purse at every moment, and he has found that he returned it to him among his money. But if he threw them into his purse in which there was nothing, he has not discharged his duty, and he bears responsibility for the robbed thing until he informs him that he returned it into such-and-such a purse. And if the owner did not know that it had been stolen from him, as soon as he returned them to their place he has discharged his duty, even though the owner did not count them.
Se’if 2ב׳
בד"א בדבר שאין בו רוח חיים אבל הגונב טלה מן העדר וידעו בו הבעלים והחזירו לעדר שלא מדעת בעלים ומת או נגנב חייב באחריותו ואם מנו את הצאן והיא שלימה פטור ואם לא ידעו הבעלים לא בגניבתו ולא בחזרתו אע"פ שמנו את הצאן והיא שלימה חייב באחריותו עד שיודיע את הבעלים כדי שישמרו את הטלה הגנוב שהרי למדו דרך אחרת חוץ מדרך שאר הצאן שבעדר זה:
In what case are these words said? With a thing that has no breath of life in it. But one who steals a lamb from the flock, and the owner knew of it, and he returned it to the flock without the owner's knowledge, and it died or was stolen — he bears responsibility for it; and if they counted the flock and it was whole, he is exempt. And if the owner knew neither of its theft nor of its return, even though they counted the flock and it was whole, he bears responsibility for it until he informs the owner, so that they may guard the stolen lamb; for it has learnt a way other than the way of the rest of the sheep in this flock.
Se’if 3ג׳
בד"א שנפטר כשמחזירו למקומו בגנב הגונב מבית הבעלים אבל שומר שגנב מרשות עצמו כגון שהופקד אתו כיס או טלה ויש עדים שגנבו אע"פ שיש עדים שהחזיר' למקומו חייב באחריותו עד שיודיע לבעלים שהרי כלתה שמירתו ואינו עוד שומר עליו והרי הוא כאילו לא החזירו עד שיודיע לבעלים:
In what case is it said that he is quit when he returns it to its place? With a thief who steals from the owner's house. But a bailee who stole from his own domain — for example, a purse or a lamb was deposited with him, and there are witnesses that he stole it — even though there are witnesses that he returned it to its place, he bears responsibility for it until he informs the owner; for his guarding has ended, and he is no longer a bailee over it, and it is as though he had not returned it until he informs the owner.
