Se’if 1א׳
השביחה הגניבה ביד הגנב. ובו ו סעיפים: הית' הגניב' ביד הגנב והשביח' מאיליה כגון כבשה שהיתה מעוברת בשעת גניב' וילדה או שהית' טעונה בשעת גניב' וגזזה משלם אותה ואת גיזותיה ואת ולדותיה ואם אחר יאוש ילדה וגזזה משלם כשעת הגניבה הוציא עליה והשביח' כגון שפטמה הרי השבח של גנב אפי' לפני יאוש וכשמחזיר הגניב' נוטל השבח מהבעלים: הגה וי"א דאפי' שבח מאליה הוא של גנב אפי' קודם יאוש וכ"ש אם גנב כבשה ונתעברה אצל גנב דהשבח של גנב אפי' תבעוה הבעלים קודם שילדה הואיל וגנבה ריקנית (טור ס"א בשם הרא"ש והראב"ד):
The stolen thing improved in the thief's hand; it contains six se'ifim. If the stolen thing was in the thief's hand and improved of itself — for example, a ewe that was pregnant at the time of the theft and gave birth, or that was laden with wool at the time of the theft and he sheared it — he pays for it, and for its fleeces, and for its young. And if after despair (of recovery) it gave birth and he sheared it, he pays as at the time of the theft. If he spent on it and improved it — for example, he fattened it — the improvement is the thief's, even before despair; and when he returns the stolen thing, he takes the improvement from the owner. Hagah [Rema]: And some say that even improvement of itself is the thief's, even before despair; and all the more so if he stole a ewe and it became pregnant with the thief, that the improvement is the thief's, even if the owner claimed it before it gave birth, since he stole it empty (Tur, se'if 1, in the name of the Rosh and the Raavad).
Se’if 2ב׳
הגניב' עצמה שהיא ביד הגנב ולא נשתנית חוזרת לבעלים בין לפני יאוש בין לאחר יאוש אלא שלאחר יאוש השבח לגנב כמו שיתבאר נשתנית הגניבה ביד הגנב קנאה וקנה שבחה אפי' לפני יאוש ואינו משלם אלא דמים (הרא"ש) ויתבארו פרטי דינין אלו בסי' שס"ב:
The stolen thing itself, which is in the thief's hand and has not changed, returns to the owner, whether before despair or after despair; except that after despair the improvement is the thief's, as will be explained. If the stolen thing changed in the thief's hand, he has acquired it and acquired its improvement, even before despair, and he pays only its value (the Rosh); and the details of these laws will be explained in siman 362.
Se’if 3ג׳
גנב בהמה או כלי וכיוצא בהם ובשעת גניבה היה שוה ארבעה ועכשיו בעת העמד' בדין שוה שנים משלם קרן כשעת גניבה הית' שוה בשעת גניבה שנים ובשעת העמדה בדין ארבעה אם שחט או מכר או שבר הכלי או אבדו משלם כשעת העמד' בדין ואם מתה הבהמ' או אבד הכלי מאליו משלם כשעת גניב':
If he stole an animal or a vessel or the like, and at the time of the theft it was worth four, and now, at the time of standing in judgment, it is worth two, he pays the principal as at the time of the theft. If at the time of the theft it was worth two, and at the time of standing in judgment four: if he slaughtered or sold it, or broke the vessel or lost it, he pays as at the time of standing in judgment; and if the animal died or the vessel was lost of itself, he pays as at the time of the theft.
