Se’if 1א׳

נשתנה הגניבה ביד הגנב או שנתייאשו בעליה ממנה. ובו ד סעיפים: נשתנה שם הגניבה ביד הגנב כגון שגנב טלה ונעשה איל עגל ונעשה שור קנאה בשינוי השם ואין להחזיר אלא דמיה ומשלם כמו שהיתה שוה בשעת הגניבה וכן כל שינוי כיוצא בזה שאינו חוזר לברייתו אבל שינוי החוזר אינו קונה אפי' מדרבנן ובסימן ש"ס יתבאר איזה שינוי החוזר:

The stolen thing changed in the thief's hand, or its owner despaired of it; it contains four se'ifim. If the name of the stolen thing changed in the thief's hand — for example, he stole a lamb and it became a ram, a calf and it became an ox — he has acquired it by the change of name, and he need return only its value, and he pays as it was worth at the time of the theft; and likewise any change of this kind that does not revert to its original state. But a change that reverts does not acquire, even by rabbinic law; and in siman 360 it will be explained which is a change that reverts.

Se’if 2ב׳

נתייאשו הבעלים מהגניבה אינו קונה וצריך להחזירה ואם יש עם היאוש שינוי השם שחוזר לברייתו י"א שקונה ואינו צריך להחזיר אלא דמיה:

If the owner despaired of the stolen thing, the thief does not acquire it, and he must return it. And if together with the despair (of recovery) there is a change of name that reverts to its original state, some say that he acquires it and need return only its value.

Se’if 3ג׳

אם יש עם היאוש שינוי רשות בין שנתייאשו ואח"כ מכר הגנב בין שנתיאשו אחר שמכר ויש חולקין (טור ס"ו בשם הרא"ש ורש"י ומרדכי ר"פ הגוזל בתרא וב"י בשם רשב"א) (וע"ל סי' שנ"ו) קנה לענין שאין הקונה צריך להחזיר גוף הגניבה אבל מחזיר דמים אם לקח מגנב מפורסם (וי"א דא"צ ליתן לו דמים דקנה לגמרי) (טור ס"ה בשם ר"י וב"י בשם רש"י ורשב"א) ואם לא הי' גנב מפורסם אינו נותן כלל לא חפץ ולא דמים מפני תקנת השוק כמו שיתבאר בסי' שנ"ו:

If together with the despair there is a change of domain — whether they despaired and afterwards the thief sold it, or they despaired after he sold it; and there are those who disagree (Tur, se'if 6, in the name of the Rosh and Rashi, and Mordechai, beginning of chapter "One who robs, the latter", and Beit Yosef in the name of the Rashba) (and see below, siman 356) — he has acquired it, in that the purchaser need not return the body of the stolen thing; but he returns its value, if he bought from a notorious thief (and some say that he need not give him its value, for he has acquired it completely) (Tur, se'if 5, in the name of the Ri, and Beit Yosef in the name of Rashi and the Rashba). And if he was not a notorious thief, he gives nothing at all, neither the object nor its value, because of the market ordinance, as will be explained in siman 356.
