Se’if 1א׳
דין פטור שאלה בבעלים עם כל דיניו ובעל בנכסי אשתו. ובו יט סעיפים: השואל והיה המשאיל עם השואל במלאכתו בשע' שמשך הדבר השאול אפי' נגנב או נאבד בפשיעה פטור שנא' אם בעליו עמו לא ישלם לא שנא היה עמו בשאלה שהשאיל את עצמו לעשות מלאכתו לא שנא היה עמו בשכירות שהשכיר עצמו לו לא שנא הי' עמו באותה מלאכה של הדבר השאול ל"ש במלאכה אחרת אפי' א"ל השקני מים והשקהו והשאיל לו פרתו בעוד שהוא משקהו הוי שאלה בבעלים אבל אם משך תחלה ואח"כ השקהו לא הוי שאלה בבעלים:
The law of the exemption of borrowing with the owner, with all its laws; and a husband with his wife's property; it contains nineteen se'ifim. One who borrows, and the lender was with the borrower in his work at the time he drew the borrowed thing — even if it was stolen or lost through negligence, he is exempt, as it is said, "If its owner is with it, he shall not pay." It makes no difference whether he was with him by borrowing, that he lent himself to do his work, or whether he was with him by hire, that he hired himself out to him; it makes no difference whether he was with him in that same work of the borrowed thing or in other work. Even if he said to him, "Give me water to drink", and he gave him to drink, and he lent him his cow while he was giving him to drink, it is borrowing with the owner. But if he drew it first and afterwards gave him to drink, it is not borrowing with the owner.
Se’if 2ב׳
לא שנא אם באו שאלת הבעלים עם שאלת הפרה כאחד לא שנא הי' הוא שאול או שכור לו ואח"כ השאיל לו פרתו פטור אפי' לא היה עמו בשעת שבירה ומיתה אבל אם לא היה עמו בשעת שאלה ואח"כ שאל את הבעלים או השכירם אין זה שאלה בבעלים אע"פ שהי' עמו בשעת שבירה ומיתה:
It makes no difference whether the borrowing of the owner and the borrowing of the cow came together, or whether he was borrowed or hired to him and afterwards lent him his cow — he is exempt, even if he was not with him at the time of the breaking and the death. But if he was not with him at the time of the borrowing, and afterwards he borrowed the owner or hired him, this is not borrowing with the owner, even though he was with him at the time of the breaking and the death.
Se’if 3ג׳
שאל הבעל ונתרצה להיות שאול לו אע"פ שלא התחיל במלאכת השואל בשעת משיכת הפרה אלא מזמין ומכין עצמו ללכת חשיב שפיר עמו במלאכתו אבל באמירה שאומר להיות שאול לו ולא הכין עצמו למלאכתו לא הוי שאלה בבעלים:
If he borrowed the owner, and he consented to be borrowed to him — even though he had not begun the borrower's work at the time of the drawing of the cow, but is making himself ready and preparing himself to go — it is rightly reckoned as being with him in his work. But by a mere statement, that he says he will be borrowed to him, and he did not prepare himself for his work, it is not borrowing with the owner.
