Se’if 1א׳

דין שואל פרה ושכר אחרת. ובו ב סעיפים: שאל שתי פרות חצי היום בשאלה וחצי היום בשכירו' המשאיל אומר בזמן השאלה מתה והלה אומר אחת מתה בזמן השאלה והאחרת איני יודע מתוך שאינו יכול לישבע ישלם השתים:

The law of one who borrows a cow and hires another; it contains two se'ifim. If he took two cows, half the day by borrowing and half the day by hire; the lender says, "It died in the time of the borrowing", and the other says, "One died in the time of the borrowing, and as for the other, I do not know" — since he cannot swear, he pays for both.

Se’if 2ב׳

וכן אם מסר לו שלשה פרות שתים שאולות ואחת שכורה המשאיל אומר שתים השאולות הן שמתו והשואל אומר אחת השאולה מתה ודאי אבל השניה שמתה איני יודע אם השאולה היא או השכורה מתוך שאינו יכול לישבע שהרי אומר איני יודע ישלם השתים:

And likewise if he handed him three cows, two borrowed and one hired; the lender says, "It is the two borrowed ones that died", and the borrower says, "One borrowed one certainly died, but the second that died — I do not know whether it is the borrowed one or the hired one" — since he cannot swear, for he says, "I do not know", he pays for both.
