Se’if 1א׳

טען שמתה מחמת מלאכה או רוצה לשלם או לישבע. ובו ד סעיפים: טען השואל שמתה מחמת מלאכה אם הוא במקום שעדים מצוים אינו נפטר עד שיביא עדים שהוא כדבריו ושלא שינה בו ואם הוא במקום שאין עדים מצויים ישבע כמו שנתבאר בסי' רצ"ד ואם התנה שלא ישבע או שלא ישלם אם נגנבה או נאנסה הכל לפי תנאו: הגה אפילו לא קנו קנין על כך דכל תנאי שומרים קיים ואפי' בלא קנין (מרדכי פ' השואל) ודוקא דאתניה קודם שבאה השמירה לידו אבל לאחר ששעבד נפשיה לא מצי לאתנויי בדברים בעלמא (מרדכי פ' החובל):

He pleaded that it died from the work, or he wishes to pay or to swear; it contains four se'ifim. If the borrower pleaded that it died from the work: if he is in a place where witnesses are to be found, he is not exempt until he brings witnesses that it is as he says, and that he did not change with it; and if he is in a place where witnesses are not to be found, he swears, as was explained in siman 294. And if he stipulated that he would not swear, or that he would not pay if it was stolen or lost by mishap, all is according to his condition. Hagah [Rema]: Even if they made no kinyan (a formal act of acquisition) on this, for every condition of bailees stands, even without a kinyan (Mordechai, chapter "One who borrows"); and specifically where he stipulated it before the guarding came into his hand, but after he has bound himself he cannot stipulate it with mere words (Mordechai, chapter "One who wounds").

Se’if 2ב׳

כשישלם השואל שמין לו השברים שאם שאל כלי ונשבר שמין לו השברים כמו שהיו שוים בשעת השבירה ונותנים לבעלים ומשלים עליהם ואם הוזלו בין שעת שבירה לשעת העמדה בדין שמין אותם כמו שהיו שוין בשעת שבירה וכן אם שאל בהמה ומתה שמין כמה היתה שוה הנבלה בשעה שמתה ונותן לו ומשלים לו עליה: הגה נגנבו השברים או נאבדו (ואפי' נאנסו) השואל חייב אא"כ אמר למשאיל טול את שלך (נ"י פ' השואל ובב"י ס"ס זה):

When the borrower pays, they assess the broken pieces for him: if he borrowed a vessel and it broke, they assess the broken pieces for him as they were worth at the time of the breaking, and they are given to the owner, and he makes up the rest on them. And if they fell in value between the time of the breaking and the time of standing in judgment, they assess them as they were worth at the time of the breaking. And likewise if he borrowed an animal and it died, they assess how much the carcass was worth at the time it died, and he gives it to him and makes up the rest on it. Hagah [Rema]: If the broken pieces were stolen or lost (and even lost by mishap), the borrower is liable, unless he said to the lender, "Take what is yours" (Nimukei Yosef, chapter "One who borrows", and in Beit Yosef, end of this siman).

Se’if 3ג׳

ראובן השאיל חפץ לשמעון והפסידו אמר שמעון לראובן השבע כמה היה שוה ואפרענו לך והשיב בעל החפץ השבע אתה והפטר ישבע בעליו ויפרע שכנגדו ע"פ שבועתו ואם לא ישבע לא יפרע שכנגדו ואינו נקרא מחויב שבועה ואינו יכול לישבע שמשלם:

Reuven lent an object to Shimon, and he lost it. Shimon said to Reuven, "Swear how much it was worth and I will pay it to you", and the owner of the object replied, "You swear and be quit" — the owner swears, and the other pays according to his oath; and if he does not swear, the other does not pay. And he is not called one who is obliged to swear and cannot swear, who pays.
