Se’if 1א׳

השואל חייב באונס ובהמה שמתה מחמת מלאכה ואם שלחה על יד בנו או עבדו. ובו ח סעיפים: השואל מחבירו בהמה או מטלטלים ונאנסו בידו כגון שמתה או נשבר או נשבה חייב: הגה ודוקא שאירע האונס מכח השואל אבל אם אירע האונס מכח המשאיל פטור ולכן מי שיש לו משכון אצל עכו"ם והשאילו לחבירו ליקח עליו עוד מעות ונשרף המשכון פטור השואל דהא בלאו הכי היה נשרף מכח המשאיל (מרדכי פרק השואל) וא"צ לומר שחייב בגניבה ואבידה אבל כל קלקול שאירע בה מחמת מלאכה ששאלה בשבילה לא מבעיא אם הוכחשה מחמת מלאכה שהוא פטור אלא אפי' מתה מחמת מלאכה פטור והוא שלא ישנה לעשות בה דבר אחר חוץ מהמלאכה ששאלה בשבילה שאם שינה ועשה בה מלאכה אחרת חוץ מהמלאכה ששאלה בשבילה אפי' היא קלה ממנה תלינן דמחמת אותה מלאכה ששינה מתה ואפי' באותה מלאכה עצמה אפשר לשנות כגון ששאלה לחרוש וחרש בה ביום ובלילה שלא כדרך כל הארץ:

A borrower is liable for mishap; and an animal that died from the work; and if he sent it by the hand of his son or his slave; it contains eight se'ifim. One who borrows from his fellow an animal or movables, and they were lost by mishap in his hand — for example, it died, or was broken, or was taken captive — is liable. Hagah [Rema]: And specifically where the mishap occurred through the borrower; but if the mishap occurred through the lender, he is exempt. And therefore one who has a pledge lodged with a gentile, and lent it to his fellow to take more money on it, and the pledge was burnt — the borrower is exempt, for even without this it would have been burnt through the lender (Mordechai, chapter "One who borrows"). And it need not be said that he is liable for theft and loss. But any damage that befell it from the work for which he borrowed it — it is not only if it was weakened from the work that he is exempt, but even if it died from the work, he is exempt; and that is where he does not change to do with it anything other than the work for which he borrowed it. For if he changed and did other work with it, apart from the work for which he borrowed it, even if it is lighter than it, we attribute it to that work in which he changed, that it died from it. And even in that same work itself it is possible to change — for example, he borrowed it to plough, and ploughed with it by day and by night, not in the way of all the world.

Se’if 2ב׳

נכחש הבשר מאליו וסופו לחזור פטור אבל אם נכחשה מאליה ומתה אח"כ שהוא חייב לשלם כיון שאינה בעין משלם כמו שהיתה בשעת שאלה:

If the flesh grew lean of itself and will in the end return, he is exempt. But if it grew lean of itself and died afterwards, so that he is liable to pay — since it is not in existence, he pays as it was at the time of borrowing.

Se’if 3ג׳

השואל בהמה מחבירו לילך דרך ידוע ובאו עליו לסטים באותו הדרך או חיות רעות ואנסוה ממנו חשיב שפיר מתה מחמת מלאכה: הגה ויש חולקין בזה וסבירא להו דלא מיקרי מחמת מלאכה דהרי אף בלא הליכת הדרך איפשר שיבא לה אונס כזה (טור בשם הרא"ש) אבל המשאיל לחבירו שונרא לרדוף עכברים ואכלוה העכברים מקרי מחמת מלאכה דבא לה האונס מחמת מלאכה וכל כיוצא בזה (טור) בהמה שנתייגעה במלאכתה ונתחממה ומתה אח"כ או נכשלה בדרך ונפלה ומתה מיקרי מחמת מלאכה ודוקא שהרגיש בעודו במלאכ' אבל אם לא הרגיש מיד לא יוכל לישבע דמתה מחמת מלאכה דדילמא בלאו הכי נמי היתה מתה (שם בשם ר"י והרא"ש) :

One who borrows an animal from his fellow to go by a known road, and bandits came upon him on that road, or wild beasts, and took it from him by force — it is rightly reckoned as having died from the work. Hagah [Rema]: And there are those who disagree on this and hold that it is not called "from the work", for even without going on the road it is possible that such a mishap would come upon it (Tur in the name of the Rosh). But one who lends his fellow a cat to chase mice, and the mice ate it — it is called "from the work", for the mishap came upon it from the work; and so anything of this kind (Tur). An animal that grew weary in its work and became heated, and died afterwards, or stumbled on the road and fell and died — it is called "from the work"; and specifically where he noticed it while he was still at the work; but if he did not notice it at once, he cannot swear that it died from the work, for perhaps it would have died even without this (there, in the name of the Ri and the Rosh).
