Se’if 1א׳
השוכר את הפועל להשקות השדה והשוכר מלמד וחלה בנו. ובו ד סעיפים: השוכר את הפועל להשקות השדה מזה הנהר ופסק הנהר בחצי היום אם אין דרכו להפסיק או אפי' שדרכו לפסוק והפועל יודע דרך הנהר פסידא דפועל ואין בעל הבית נותן לו כלום אע"פ שגם בע"ה יודע דרך הנהר אבל אם אין הפועל יודע דרך הנהר ובע"הב יודע נותן לו שכרו כפועל בטל: הגה וכן בכל אונס שאירע לפועל בין ששניהם היו יודעין שדרך האונס לבא או ששניהן אינו יודעין הוי פסידא דפועל אבל אם בע"ה יודע והפועל אינו יודע הוי פסידא דבעל הבית (טור ס"ב) ואם הוי מכת מדינה ע' לעיל סי' שכ"א מי ששכר בית לדור בו ומת בתוך זמן השכירות א"צ לשלם לו רק מה שדר בו דבע"ה הוי כפועל והוי ליה להתנות (מרדכי פ' האומנין) מיהו יש חולקין (ב"י בס"ס שי"ב בשם תשובת רשב"א אלף וכ"ח ובשם תוס' פ' חזקת ות"ה סי' שכ"ט וכן משמע תשובת רשב"א שהביא הב"י סי' של"ה) לכן אם קבל השכר כולו א"צ להחזיר כלום כן נראה לי אם ברחו מחמת שינוי אויר הוי כשאר אונס והוי פסידא דפועל או המלמד (תשובת מהרי"ל סי' מ"א ומהר"ם פאדווה סי' פ"ו):
One who hires a worker to water the field from this river, and the river stops up for half the day, if there isn’t any way to stop or even that his way is to interrupt and the worker knows the way of the river, the loss of the worker and the employer doesn’t give him anything, even though that also the employer knows the way of the river. But if the worker doesn’t know the way of the river, and the employer knows, he gives the worker workman’s comp. Note: and similarly in every case of extraordinary circumstance that happens to the worker, whether the two of them knew that the way of the compulsion to come or the two of them didn’t know, it comes to be the loss of the worker. But if the employer knows and the worker doesn’t know, it comes to be the loss is of the employer. And if a naturally occurring complete disaster comes consider above siman 321. Someone that rents a house to live in it, and dies within the time of the rental, doesn’t have to pay only the time that he dwelled in it, because the owner of the house comes to be like the worker, and he should have made it a condition. There are those who disagree. Therefore, if he received all the rent payment, there is no need to return them all, so it seems to me. If they run away because of a change in weather, it comes to be like the other forces, and it comes to be the loss of the worker or the teacher.

שכרו להשקות שדהו ובא מטר בלילה בענין שאינו צריך אינו נותן לו כלום וכן אם בא בחצי היום אינו נותן לו מחצי היום ואילך כלום אבל אם בא הנהר נותן להם כל שכרן מן השמים נסתייעו: הגה שכר פועלים לחפור שדהו ובא מטר בלילה בענין שאין יכולין לחפור אם לא ראו הפועלים הקרקע פסידא דבע"ה הוא דהו"ל להודיעם שלא יבאו י"א דאם ביקר בע"ה המלאכה מבערב וראה שצריכים פועלים פטור בכל ענין (הכל בטור ס"א) וע' לעיל סי' של"ג סעיף א' וב'. י"א הא דאמרי' דאם אירע אונס הוי פסידא דפועלים היינו ששכרם למלאכה ידועה אבל אם שכרן סתם יכול לומר תן לי מלאכה אחרת כזו (ת"ה סי' שכ"ט):
If he hired him to water his field, and rain came in the night in such a way that it does not need it, he gives him nothing; and likewise if it came in the middle of the day, he gives him nothing from the middle of the day onwards. But if the river came, he gives them their whole wage: they were helped from Heaven. Hagah [Rema]: If he hired workers to dig his field, and rain came in the night in such a way that they cannot dig — if the workers had not seen the ground, it is the householder's loss, for he should have let them know not to come. Some say that if the householder inspected the work the evening before and saw that it needed workers, he is exempt in every case (all this is in the Tur, se'if 1); and see above, siman 333, se'ifim 1 and 2. Some say that what we say, that if a mishap occurred it is the workers' loss, is where he hired them for a particular work; but if he hired them without specifying, the worker can say, "Give me other work like this" (Terumat haDeshen, siman 329).

בד"א בפועל אבל מי שפסק עם אריסו שאם ישקה שדה זו ד' פעמים ביום יטול חצי הפירות וכל האריסין שהם משקין שני פעמים אינם נוטלים אלא רביע הפירות ובא המטר ולא הוצרך לדלות ולהשקות נוטל חצי הפירו' כמו שפסק עמו שהאריס כשותף ואינו כפועל:
In what case are these words said? With a worker. But one who settled with his sharecropper that if he waters this field four times a day he takes half the produce — while all the sharecroppers, who water twice, take only a quarter of the produce — and the rain came and he did not need to draw water and water it, he takes half the produce as he settled with him; for the sharecropper is as a partner and is not as a worker.
