Se’if 1א׳
השוכר את הפועל ובא הפועל לחזור קודם שהתחיל או אחר כן. ובו ח סעיפים: השוכר את הפועלים והטעו את בעה"ב או בעל הבית הטעה אותם אין להם זה על זה אלא תרעומות: הגה וי"א דאם משך ב"ה כלי אומנות שעושה בהם מלאכה אין הב"ה יכול לחזור בו ולא הפועל אם הוא קבלן (טור בשם ר"ת) אבל אם הוא שכיר יום יכול לחזור כמו שנתבאר (תוס' והרא"ש ריש פרק הזהב) מיהו יכול לעכב כלי אומנתו ולשכור אחרים (מרדכי פרק האומנין ונ"י בשם תלמידי רשב"א והמגיד פרק ט') בד"א בשלא הלכו אבל הלכו החמרים ולא מצאו תבואה פועלים ומצאו שדה כשהיא לחה או ששכרם להשקות השדה ומצאוהו שנתמלא מים אם ביקר ב"ה מלאכתו מבערב ומצאה שצריכה פועלים אין לפועלים כלום ומה בידו לעשות ואם לא ביקר נותן להם שכרן כפועל (פי' ששמין מי שהשכיר עצמו למלאכה זו וכן חמר שהשכיר חמור להביא משאוי כמה היה רוצה לפחות משכרו ולישב בטל ולבא ריקן) בטל שאינו דומה הבא טעון לבא ריקן ועושה מלאכה לבטל:
One who hires a worker, and the worker comes to retract before he began or afterwards; it contains eight se'ifim. One who hires workers, and they deceived the householder, or the householder deceived them — they have against one another only a grievance. Hagah [Rema]: And some say that if the householder drew the craftsman's tools with which the work is done, the householder cannot retract, nor can the worker if he is a contractor (Tur in the name of Rabbeinu Tam); but if he is a day-worker, he can retract, as has been explained (the Tosafot and the Rosh, beginning of chapter "The gold"). However, he can hold back his craftsman's tools and hire others (Mordechai, chapter "The craftsmen", and Nimukei Yosef in the name of the students of the Rashba, and the Maggid, chapter 9). In what case are these words said? Where they had not gone. But if they had gone — the donkey-drivers, and they found no grain; workers, and they found the field wet; or he hired them to water the field and they found that it had filled with water — if the householder inspected his work the evening before and found that it needed workers, the workers have nothing, for what could he have done? And if he did not inspect it, he gives them their wage as an idle labourer (that is, they assess what one who hired himself out for this work would be willing to take off his wage to sit idle; and likewise a donkey-driver who hired out a donkey to bring a load, to come back empty), for one who comes laden is not like one who comes empty, nor one who does work like one who is idle.

בד"א שאין להם עליו אלא תרעומות בשלא הלכו דוקא בשלא היו יכולים להשכיר עצמם אמש כששכרם ב"ה זה אבל אם היו נשכרים אמש ועכשיו אינם נשכרים כלל ה"ז כדבר האבוד להם ונותן להם שכרם כפועל בטל ואם נשכרים בפחות משלם הפחת ואם הלכו ודוקא שהלכו עצמם אבל לא שלוחם (המגיד פ"ט בשמם) אע"פ שלא היו מוצאים להשכיר עצמם אמש נותן להם שכרם כפועל בטל והוא שעכשיו אינם נשכרים כלל אבל אם מוצאים מי שישכירם בשכירותו אין להם אלא תרעומת (וי"א דאפי' לא מצאו רק מלאכה כבידה מזו רק שרוצים להוסיף בשכרן צריכין להשכיר עצמן במקום אחר (מרדכי פ' האומנין בשם מהר"ם) ויש חולקין (ב"י בשם תלמידי רשב"א) ואם אינם מוצאים להיות נשכרים אלא בפחות משלם להם הפחת וכל אלו הדינים כשלא ביקר בעה"ב מלאכתו מבערב שהוא בפשיעתו אבל אם לא היתה פשיעת בעל הבית בדבר כלל ה"ז אנוס ונפטר כמו שנתבאר: הגה ועיין לקמן סי' של"ד סעיף ב' מלמד שהשכיר עצמו לשני שנים והתחיל שנה ראשונה מקרי התחלה גם לשנה שניה וה"ה כל פועל (הגה"מ פ' האומנין):
In what case is it said that they have against him only a grievance where they had not gone? Specifically where they could not have hired themselves out last night, when this householder hired them. But if they could have been hired last night, and now they cannot be hired at all, this is as a thing lost to them, and he gives them their wage as an idle labourer; and if they can be hired for less, he pays the shortfall. And if they had gone — and specifically where they went themselves, but not their agent (the Maggid, chapter 9, in their name) — even though they would not have found anyone to hire themselves out to last night, he gives them their wage as an idle labourer; and that is where now they cannot be hired at all. But if they find someone who will hire them at their hire, they have only a grievance (and some say that even if they found only work heavier than this, provided that the other is willing to add to their wage, they must hire themselves out elsewhere) (Mordechai, chapter "The craftsmen", in the name of the Maharam); and there are those who disagree (Beit Yosef in the name of the students of the Rashba). And if they cannot find hire except for less, he pays them the shortfall. And all these laws apply where the householder did not inspect his work the evening before, so that it is through his negligence; but if there was no negligence of the householder in the matter at all, he is under duress and is exempt, as has been explained. Hagah [Rema]: And see below, siman 334, se'if 2. A teacher who hired himself out for two years and began the first year — it is called a beginning for the second year too; and the same applies to any worker (Hagahot Mordechai, chapter "The craftsmen").

התחיל הפועל במלאכה וחזר בו בחצי היום חוזר ואפי' קבל כבר דמי שכירות ואין בידו לשלם לבעל הבית יכול לחזור בו והמעות חוב עליו שנאמר כי לי בני ישראל עבדים ולא עבדים לעבדים: הגה ומה"ט אסור לפועל אפי' מלמד או סופר להשכיר עצמו להיות בבית בעל הבית בקבע שלשה שנים (הגהות מרדכי פרק האומנין):
If the worker began the work and retracted in the middle of the day, he may retract; and even if he has already received the hire money and does not have the means to repay the householder, he can retract, and the money is a debt upon him, as it is said, "For to Me the children of Israel are servants" — and not servants to servants. Hagah [Rema]: And for this reason it is forbidden for a worker, even a teacher or a scribe, to hire himself out to be in the householder's house fixedly for three years (Hagahot Mordechai, chapter "The craftsmen").
