One who hires a worker for unspecified work or for a particular work; it contains three se'ifim. One who hires a worker for a particular work, and it was completed in the middle of the day: if he has work like it, or lighter than it, the worker does it; and if he has none, he gives him his wage as an idle labourer. Hagah [Rema]: And if he wishes to take work like this from his fellow and give it to the worker, he has the right; and some say that if he is willing to add to his wage, he must do even work heavier than the first (all this is in Mordechai, chapter "The craftsmen"). And if he was one of the diggers, or the tillers of the soil, and the like, whose way is to toil a great deal, and if he does no work he will fall sick, he gives him his whole wage in full; and specifically where he did not show him that work beforehand; but if he showed it to him, and he saw that it did not hold a day's work, and he made no condition, he gives him nothing after it was completed, as was explained in the siman before this, that whatever both of them know, it is for the worker to make a condition. And if he hired him without specifying for one day's work, he can change him from light work to heavy. Hagah [Rema]: A teacher whose pupil fell sick — it was explained at the end of siman 334 (Tur, beginning of siman 334, and the Ramban in a responsum, siman 1). Where it is the householder's loss, he must give him his whole wage in full, and not as an idle labourer, for if they do not work they grow weak; and even if he has other pupils with whom he studies, for speech to one is speech to a hundred (Beit Yosef in the name of the Rashba, siman 1042, and Rabbeinu Yerucham, netiv 29, part 3). And the householder cannot give him another boy to study with him (responsum of the Ramban, siman 1); and some say that he can give him another boy who understands and is as sharp as the first, but not one harder than he (Mordechai, chapter "The craftsmen"); and so it seems to me to rule. And that which they must give the teacher his wage in full is specifically if it appears to the court that he benefits from his teaching more than from his idleness; but if it appears to the court that idleness is more agreeable to him, he gives him only as any other idle labourer (responsum of the Rashba, siman 643 and siman 1042). One who teaches his fellow's son without the father's knowledge — some say that he must pay him according to the law of one who goes down into his fellow's field without permission, which will be explained below, siman 375 (Mordechai there, and Hagahot Mordechai there); and there are those who disagree (responsum of the Rashba, siman 645). And if someone says to a teacher, "Study with my son", and did not fix a hire with him, he must give him according to what others give (Mordechai, cited above, in the name of the Maharam). A householder who hired a teacher and said that he would go to his relative to test him, whether he is able to study with the boy, and he did not go; and after he had studied with him he says that he will still test him, and one witness testifies that he did not know how to study with him — the law is with the teacher: since he knows now, we set him on the presumption that he knew already, and he swears against the witness and takes his wage (Mordechai, chapter "One who died"). A rabbi who was in a town several years and gave rulings to the community, and afterwards they fixed a wage with him for the future — he cannot claim for what is past, for he certainly waived it for them (Maharam Padua, siman 40). A worker who took upon himself every mishap, and a mishap came that is not common at all — he is exempt, for he did not make his condition for this (Beit Yosef, end of siman 332); and so it is in the Talmud, chapter "One who was seized". One who hired a horse for eight days to go to a certain place, and when he had gone two days he changed his mind and returned to his place — he can do what he wishes with the horse in these six days, to hire it out in the town to bring wood, or other work particular to horses in that town, even though this work is heavier than the first; for the owner is content that his animal should be in the town and do heavier work rather than go to a distant place (Teshuvot Maimoniyot, Sefer Mishpatim, siman 24).

השוכר את הפועל להביא לו שליחות ממקום למקום והלך ולא מצא שם מה שיביא נותן לו שכרו משלם: הגה דהרי כבר עשה שליח שליחותו (המגיד פ"ט) אבל אם שלח שליח עם איגרת ומצא מי שנשלחו אליו וחזר אין לשליח כלום אא"כ הוי לבעה"ב לידע ולא לשליח דאז הוי פסידא דבע"ה כמו שנתבאר לעיל סי' של"ד (מרדכי פ' האומנין והגהות מרדכי דקידושין ): ואם היה דבר כבד מה שיש לו להביא מנכה לו שאינו דומה בא טעון לבא ריקם אא"כ הוא מאותם אנשים שדרכם לטרוח:

One who hires a worker to bring him something on an errand from place to place, and he went and did not find there what to bring — he gives him his wage in full. Hagah [Rema]: For the agent has already done his agency (the Maggid, chapter 9). But if he sent an agent with a letter, and he met the one to whom it was sent, and returned, the agent has nothing — unless it was for the householder to know and not for the agent, for then it is the householder's loss, as was explained above, siman 334 (Mordechai, chapter "The craftsmen", and Hagahot Mordechai on Kiddushin). And if what he had to bring was a heavy thing, he deducts for him, for coming laden is not like coming empty — unless he is one of those people whose way is to toil.

Se’if 3ג׳

שכרו להביא תפוחים לחולה והלך והביא ומצאו שמת או שהבריא לא יאמר טול מה שהבאת בשכרך אלא נותן לו כל שכרו וכן כל כיוצא בזה :

If he hired him to bring apples for a sick person, and he went and brought them, and found that he had died or recovered, he may not say, "Take what you brought as your wage"; rather, he gives him his whole wage; and likewise anything of this kind.
