Se’if 1א׳
דין האומר לשלוחו צא ושכור לי פועלים ושכרן יותר ממה שאמר לו. ובו ז סעיפים: אמר לשלוחו צא ושכור לי פועלים בשלשה והלך ושכרן בארבעה אם אמר להם השליח שכרכם עלי נותן להם ארבעה ונוטל מבעל הבית שלשה ומפסיד אחד מכיסו (וי"א אם כל הפועלים אינן נשכרים רק בארבע הבעל הבית נותן לשליח כפי מה שההנהו) (טור ס"א וע' בב"י) ואם אמר להם שכרכם על בעל הבית נותן להם ב"ה כמנהג המדינה היה במדינה מי שנשכר בג' ומי שנשכר בד' אינו נותן להם אלא ג' ויש להם תרעומת על השליח במה דברים אמורים כשאין מלאכתן ניכרת אבל אם היתה מלאכתן ניכרת והרי שוה ד' נותן להם ב"ה ד' שאילו לא אמר להם שלוחו ארבעה לא טרחו ועשו שוה ארבעה:
The law of one who says to his agent, "Go out and hire workers for me", and he hired them for more than he told him; it contains seven se'ifim. If he said to his agent, "Go out and hire workers for me at three", and he went and hired them at four: if the agent said to them, "Your wage is upon me", he gives them four and takes three from the householder, and loses one from his own purse (and some say that if all the workers are hired only at four, the householder gives the agent according to what he benefited him) (Tur, se'if 1, and see Beit Yosef). And if he said to them, "Your wage is upon the householder", the householder gives them according to the custom of the country: if there was in the country one who is hired at three and one who is hired at four, he gives them only three, and they have a grievance against the agent. In what case are these words said? When their work is not recognisable; but if their work was recognisable, and it is worth four, the householder gives them four; for had his agent not told them four, they would not have taken the trouble to do work worth four.
Se’if 2ב׳
אמר לו בעל הבית שכור לי בארבעה והלך השליח ושכר בשלשה אע"פ שמלאכתן שוה ד' אין להם אלא ג' שהרי קיבלו על עצמם ויש להם תרעומת על השליח (ול"ש אמר שכרכם עלי או שאמר להם שכרכם על בעל הבית) (טור ס"א):
If the householder said to him, "Hire for me at four", and the agent went and hired at three, then even though their work is worth four, they have only three, since they accepted it upon themselves; and they have a grievance against the agent (and there is no difference whether he said, "Your wage is upon me", or said to them, "Your wage is upon the householder") (Tur, se'if 1).
Se’if 3ג׳
אמר לו בע"ה בג' והלך השליח ואמר להם בד' ואמרו הריני כמו שאמר בעל הבית אין דעתם אלא שיתן בעל הבית יתר על ארבעה לפיכך שמין מה שעשו אם שוה ארבעה נוטלין ארבעה מבעל הבית ואם אינו שוה או שאינו ידוע אין להם אלא שלשה: הגה ואם אמר השליח שכרכם עלי בכל ענין נותן להם ארבעה וכן אם לא היו פועלים נשכרים רק בארבעה (טור ס"ב):
If the householder told him "at three", and the agent went and told them "at four", and they said, "We are as the householder said" — their intention was only that the householder should give more than four. Therefore they appraise what they did: if it is worth four, they take four from the householder; and if it is not worth it, or it is not known, they have only three. Hagah [Rema]: And if the agent said, "Your wage is upon me", he gives them four in any case; and likewise if workers were hired only at four (Tur, se'if 2).
