Se’if 1א׳
דין מקבל שרוצה להסתלק מפני רעת השדה. ובו ב סעיפים: המקבל שדה מחבירו ולא עשתה אם יש בה כדי להוציא סאתים יתר על ההוצאה חייב המקבל ליטפל בה שכך כותב לבעל הקרקע אנא אקום ואזרע וכו' ואעמיד כרי לפניך ותטול חלקך וכו' (ואפי' לא כתב כך כמאן דכתיב דמי) (המגיד פרק י"ח דשכירות וב"י בשם התו' והרא"ש):
The law of a tenant on shares who wishes to withdraw because of the poorness of the field; it contains two se'ifim. One who receives a field from his fellow, and it did not yield: if there is enough in it to bring out two se'ah beyond the outlay, the tenant on shares is obliged to take trouble with it; for so he writes to the owner of the land: "I will rise and sow, etc., and set up a stack before you, and you will take your share, etc." (and even if he did not write so, it is as though it were written) (the Maggid, chapter 18 of the Laws of Hire, and Beit Yosef in the name of the Tosafot and the Rosh).
Se’if 2ב׳
לא עבדה אלא הובירה כולה או מקצתה שמין אותה כמה היא ראויה לעשות ונותן לו חלקו שהי' מגיע לו ואם התנה עמו אם אוביר ולא אעביד אשלם אלף זוז הרי זו אסמכתא ואינו חייב לשלם אלא נותן כפי מה שראויה לעשות בלבד:
If he did not work it but left it fallow, wholly or in part, they appraise how much it was fit to yield, and he gives him the share that would have reached him. And if he stipulated with him, "If I leave it fallow and do not work it, I will pay a thousand zuz", this is an asmachta (an undertaking made to hang on a condition), and he is not obliged to pay; rather, he gives only according to what it was fit to yield.
