המקבל שדה מחבירו אם רשאי לזורע' פשתן. ובו סעיף אחד: המקבל שדה מחבירו לשנים מועטות לא יזרענה פשתן ואין לו בקורות שקמה וכיוצא בה ולא בשבח האילנות שיצאו מאליהם בשדה אבל מחשבים לו מקום האילנות כאילו היה בהם אותה זרע שזרע בכל השדה והוא שצמחו האילנות במקום הראוי לזריעה: הגה וי"א דאם הוא אומר דגם הוא היה נוטע אילנות צריך ליתן לו מן האילנות כאלו נטען אבל אם אומר שיותר הי' חפץ לזרוע מליטע אילנות אם האילנות ראוין ליטע במקום אחר צריך ליתן לו בשבילם דמי נטיעות העומדי' ליטע ואם אינן ראויין ליטע אינו נותן לו אלא דמי עצים (טור ס"ב) אבל אם יצאו במקו' שאינו ראוי לזריעה אין מחשבים לו כלום ואם קבלה ממנו לשבע שנים זורעה שנה ראשונה פשתן ויש לו בקורת שקמה וכיוצא בה:
One who receives a field from his fellow: whether he may sow it with flax; it contains one se'if. One who receives a field from his fellow for a few years shall not sow it with flax; and he has no share in the sycamore beams and the like, nor in the improvement of the trees that came up of themselves in the field; but they reckon for him the place of the trees as though there were in it the same seed that he sowed in the whole field — provided the trees grew in a place fit for sowing. Hagah [Rema]: And some say that if he says that he too would have planted trees, he must give him from the trees as though he had planted them; but if he says that he would have wished to sow rather than to plant trees, then if the trees are fit to be planted in another place, he must give him on their account the value of saplings standing to be planted; and if they are not fit to be planted, he gives him only the value of wood (Tur, se'if 2). But if they came up in a place that is not fit for sowing, they reckon nothing for him. And if he received it from him for seven years, he sows it with flax the first year, and he has a share in the sycamore beams and the like.
