המקבל שדה לזורעה מין ידוע ובא לשנותה. ובו סעיף אחד: החוכר שדה מחבירו לזורעה שעורים לא יזרענה חטים מפני שהחטים מכחישות את הקרקע יותר מהשעורים חכרה לזורעה חטים יזרענה שעורים קטנית לא יזרענה תבואה תבואה יזרענה קטנית (וי"א בהפך תבואה לא יזרענה קטנית קטנית יזרענה תבואה) (טור ס"א) ובבבל וכיוצא בה לא יזרענה קטנית מפני שהקטנית שם מכחשת את הארץ: (הגה וי"א בהפך דבבבל יכול לזרוע מה שירצה (טור) י"א דכל זה בחכירות אבל בקבלנות יכול לשנות אפי' לדבר המכחיש (טור ורש"י) ויש חולקין וסבירא להו אפי' לדבר שאינו מכחיש אינו יכול לשנות בקבלנות (המגיד פרק ח דשכירות ):

One who receives a field to sow it with a known kind, and comes to change it; it contains one se'if. One who takes a field from his fellow for a fixed rent to sow it with barley shall not sow it with wheat, because wheat exhausts the soil more than barley. If he took it for a fixed rent to sow it with wheat, he may sow it with barley. Pulse, he shall not sow it with grain; grain, he may sow it with pulse (and some say the reverse: grain, he shall not sow it with pulse; pulse, he may sow it with grain) (Tur, se'if 1). And in Babylonia and the like he shall not sow it with pulse, because pulse there exhausts the land. Hagah [Rema]: And some say the reverse, that in Babylonia he may sow what he wishes (Tur). Some say that all this is in a fixed-rent tenancy; but in a tenancy on shares he may change, even to a thing that exhausts (Tur and Rashi). And there are those who disagree and hold that in a tenancy on shares he cannot change even to a thing that does not exhaust (the Maggid, chapter 8 of the Laws of Hire).
