המקבל שדה מחבירו ולקתה בעומריה. ובו סעיף אחד: החוכר שדה מחבירו בעשרה כורים חטים ולקתה נותן לו מתוכה היו חטין יפות לא יאמר לו הריני לוקח מן השוק אלא נותן לו מתוכה: הגה בד"א שלא שינה אבל שינה כגון שהתנה לזורעה חטין והוא יתן לו שעורים בחכירתו וזרעה שעורים ולקתה אינו נותן לו מתוכה אלא קונה לו שעורין מן השוק (טור) חכר ממנו כרם בעשרה סלי ענבים והקריסו (פי' הפיגו טעמם ונתחמצו וגירסת רש"י דכדום ופי' שהתליעו) אחר שנבצרו וכן עמרים שלקו אחר שנקצרו נותן לו מתוכן אבל אם חכרו בי' כדים יין והחמיץ חייב ליתן לו יין טוב:
One who receives a field from his fellow, and it was stricken in its sheaves; it contains one se'if. One who takes a field from his fellow for a fixed rent of ten kor of wheat, and it was stricken, gives him from it. If its wheat was fine, he shall not say to him, "I will buy from the market"; rather, he gives him from it. Hagah [Rema]: In what case are these words said? Where he did not change; but if he changed — for example, he stipulated to sow it with wheat, and he would give him barley as his rent, and he sowed it with barley and it was stricken — he does not give him from it, but buys him barley from the market (Tur). If he took a vineyard from him for a fixed rent of ten baskets of grapes, and they went bad (that is, their taste weakened and they turned sour; and Rashi's reading is "dakhdum", and he explains that they became wormy) after they were harvested — and likewise sheaves that were stricken after they were reaped — he gives him from them; but if he took it for a fixed rent of ten jars of wine, and it turned sour, he is obliged to give him good wine.
