המקבל בית השלחין ושדה האילן ויבשו. ובו ב סעיפים: החוכר או המקבל שדה מחבירו והוא בית השלחין או בית האילן ויבש מעין בית השלחין ולא פסק הנהר הגדול אלא אפשר להביא ממנו בדלי או שנקצץ האילן של בית האילנות אינו מנכה לו מחכירו ואם מכת מדינה היא כגון שיבש הנהר מנכה לו מחכירו: הגה אבל בקבלנות אינו מנכה לו כלום אלא חולקין במה שנמצא כפי תנאם (המגיד פ"ח דשכירות נ"י ר"פ המקבל) והא דאמרי' אם מכת מדינה היא מנכה לו מן חכירו הוא הדין בכל כיוצא בזה דכל מקום שנפסד הענין לגמרי והוי מכת מדינה מנכה לו משכירותו ואם אפשר לתקנו ע"י טורח ותחבולות אינו מנכה לו (מהר"ם פאדוואה סי' ל"ט) וכל מקום שמנכה לו אין חילוק במה שעבר או להבא וכן פסק מהר"ם על מלמד שגזר המושל שלא ילמוד דהוי מכת מדינה וכל ההפסד על בעל הבית (מרדכי פ' האומנין) ויש חולקין וסבירא להו דמכאן ולהבא בדין חזרה קאי כמו דאמרינן לעיל סי' ש"י לענין השוכר חמור ומת ואם לא חזר איהו דאפסיד אנפשיה ומחל (מוהר"ם פאדוואה הנ"ל) והסברא הראשונה נ"ל עיקר:
One who receives an irrigated field or a field of trees, and they dried up; it contains two se'ifim. A tenant for a fixed rent or a tenant on shares who takes a field from his fellow, and it is an irrigated field or a field of trees: if the spring of the irrigated field dried up, but the great river did not cease, and it is possible to bring water from it with a bucket; or if the tree of the field of trees was cut down — he does not deduct for him from his rent. And if it is a regional calamity — for example, the river dried up — he deducts for him from his rent. Hagah [Rema]: But in a tenancy on shares he deducts nothing for him; rather, they divide what is found according to their condition (the Maggid, chapter 8 of the Laws of Hire; Nimukei Yosef, beginning of chapter "One who receives"). And what we say — that if it is a regional calamity he deducts for him from his rent — the same holds in every case like this: wherever the matter is wholly lost and it is a regional calamity, he deducts for him from his rent; and if it is possible to repair it through trouble and contrivances, he does not deduct for him (Maharam Padua, siman 39). And wherever he deducts for him, there is no distinction between what is past and what is to come. And so the Maharam ruled concerning a teacher whom the ruler decreed should not teach, that it is a regional calamity and all the loss is upon the householder (Mordechai, chapter "The craftsmen"). And there are those who disagree and hold that from now onward it stands under the law of retraction, as we said above, siman 310, regarding one who hires a donkey and it died; and if he did not retract, it is he who caused himself the loss, and he has waived it (Maharam Padua, mentioned above). And the first view seems to me the main one.

היה עומד בתוך השדה ואמר לו בית השלחין זה אני משכיר לך בית האילן הזה אני משכיר לך יבש המעיין או נקצץ האילן מנכה לו מחכירו שהרי הוא עומד בתוכה ולא אמר לו הזה אלא כמי שאומר כמות שהיא עתה אני משכיר: הגה וי"א דוקא שנקצצו האילנות שלא נשאר מטע עשרה לבית סאה ויבש המעיין כולו אבל אם נשאר מטע עשרה לבית סאה או שלא יבש המעיין לגמרי אינו מנכה לו (טור) לפיכך אם לא היה עומד בתוכה וא"ל בית השלחין אני משכיר לך או בית האילן ויבש המעין או שנקצץ האילן אינו מנכה לו מחכירו: הגה וי"א דוקא שאמר מחכיר לחוכר אבל אם אמר חוכר למחכיר בית השלחין אני חוכר ממך מנכה לו אע"פ שאינו עומד בתוכה (טור בשם הרמ"ה והמגיד פרק ח' דשכירות ונ"י פרק המקבל):
If he was standing within the field and said to him, "This irrigated field I am letting to you", "this field of trees I am letting to you", and the spring dried up or the tree was cut down, he deducts for him from his rent; for he is standing within it, and he said to him "this" only as one who says, "As it is now I am letting it". Hagah [Rema]: And some say that this is specifically where the trees were cut down so that there did not remain a planting of ten to a beit se'ah (the space in which a se'ah of seed is sown), and the spring dried up entirely; but if a planting of ten to a beit se'ah remained, or the spring did not dry up entirely, he does not deduct for him (Tur). Therefore, if he was not standing within it and said to him, "An irrigated field I am letting to you", or "a field of trees", and the spring dried up or the tree was cut down, he does not deduct for him from his rent. Hagah [Rema]: And some say that this is specifically where the lessor said so to the tenant for a fixed rent; but if the tenant for a fixed rent said to the lessor, "An irrigated field I am taking from you for a fixed rent", he deducts for him, even though he is not standing within it (Tur in the name of the Ramah, and the Maggid, chapter 8 of the Laws of Hire, and Nimukei Yosef, chapter "One who receives").
