Siman 320 of 427 in Choshen Mishpat — 5 se'ifim

Leases and Contracts· siman 320

Choshen Mishpat is set from the Lemberg 1898 edition, which is unpointed, so the vowels switch has nothing to remove here.

Se’if 1א׳

A tenant on shares or a tenant for a fixed rent from his fellow: how they are to conduct themselves with one another; it contains five se'ifim. One who rents a field from his fellow to sow it, or a vineyard to eat its fruits, for money, or who rented it from him for a fixed quantity of produce — they have one law; and the one who rents for produce is the one called a tenant for a fixed rent.

Se’if 2ב׳

One who receives a field or an orchard in order to work it and to lay out expenses on it, and to give the owner of the land a third of the crops, or a quarter, or whatever they settle between them — he is the one called a tenant on shares. Hagah [Rema]: And they do not write a document between them except with the consent of both of them, for once the document is written they cannot retract, and it becomes like a loan by document; and the tenant on shares pays the fee for writing the document (Tur).

Se’if 3ג׳

Everything that is for the upkeep of the land, the owner of the land is liable for it; and everything that is extra guarding, the tenant for a fixed rent or the tenant on shares is liable for it. The spade with which they dig the ground, and the vessels in which they carry the earth, and the bucket and the jar and the like with which they draw the water, are upon the owner of the land; and the scooping out of the places in which the water collects is upon the tenant for a fixed rent or upon the tenant on shares (and some say that with a tenant for a fixed rent nothing at all is upon the owner of the field) (Tur in the name of "some say", and that so it stands to reason, and so it seems to me).
