מי שהטעה חבירו עד שהכניס פירותיו לביתו. ובו סעיף אחד: מי שהכניס פירותיו לבית חבירו שלא מדעתו או שהטעהו עד שהכניס פירותיו והניחם והלך יש לבעל הבית למכור לו מאותם הפירות כדי ליתן שכר הפועלים שמוציאין אותם ומשליכים אותם לשוק ומדת חסידות הוא שיודיע לב"ד וישכירו במקצת דמיהם מקום משום השבת אבידה לבעלים אע"פ שלא עשה כהוגן וי"א דצריך להודיעו תחילה ואם נאנסו לאחר שהודיעוהו פטור (הרא"ש וטור):
One who misled his fellow until he brought his produce into his house; it contains one se'if. One who brought his produce into his fellow's house without his knowledge, or who misled him until he brought in his produce, and left them and went away — the owner of the house may sell of that produce against him, so as to give the wage of the workers who take them out and throw them into the market. And it is a trait of piety that he should inform the court, and they hire a place with part of their value, because of restoring a lost thing to its owner, even though he did not act properly. And some say that he must inform him first; and if they were lost by mishap after they informed him, he is exempt (the Rosh and Tur).
