Se’if 1א׳

אמר השוכר פרעתי שכר הבית והמשכיר אומר לא פרעת. ובו ד סעיפים: השוכר שאמר נתתי שכר הבית שנתחייבתי בו והמשכיר אומר עדיין לא נטלתי בין שהיתה בשטר (או בעדים) בין שהיתה בלא עדים אם תבעו בתוך (זמן השכירות כגון ששכרו) לל' יום (ותבעו בתוך ל') (טור) על השוכר להביא ראיה או יתן ויחרים על מי שלקח ממנו שלא כדין או יטעון עליו בדמים שנתן תחלה טענה בפני עצמה וישביענו היסת ואם תבעו המשכיר לאחר ל' יום אפי' ביום ל' על המשכיר להביא ראיה או ישבע השוכר שכבר נתן לו שכרו ויפטר וכן אם שכר ממנו שיתן לו השכר שנה בשנה ותבעו בתוך השנה על השוכר להביא ראיה תבעו לאחר השנה ואפי' ביום אחרון של השנה על המשכיר להביא ראיה (וע' לעיל סי' ע"ח סעיף ג'):

If the tenant said, "I have paid the rent of the house", and the landlord says, "You have not paid"; it contains four se'ifim. A tenant who said, "I have given the rent of the house that I owed", and the landlord says, "I have not yet taken it" — whether it was by document (or before witnesses) or whether it was without witnesses: if he claimed from him within (the time of the rental — for example, he rented it) for thirty days (and claimed from him within the thirty) (Tur), the tenant must bring proof or give; and he may pronounce a cherem (the severer form of the ban) on whoever took from him unlawfully, or he may plead against him concerning the money he gave earlier as a claim by itself and make him swear the oath of hesset (the oath the Sages imposed on one who denies a claim outright). And if the landlord claimed from him after thirty days, even on the thirtieth day, the landlord must bring proof, or the tenant swears that he has already given him his rent, and is exempt. And likewise, if he rented from him on terms that he would give him the rent year by year, and he claimed from him within the year, the tenant must bring proof; if he claimed from him after the year, and even on the last day of the year, the landlord must bring proof (and see above, siman 78, se'if 3).

המשכיר בית לחבירו בשטר לעשרה שנים ואין בו זמן השוכר אומר עדיין לא עבר מזמן השטר אלא שנה והמשכיר אומר כבר עברו ושלמו שני השכירות ושכנת עשרה שנים על השוכר להביא ראיה ואם לא הביא ראיה ישבע המשכיר היסת ויוציאנו (וה"ה בשאר טענות שביניהן) (מרדכי ס"פ השואל) ומיהו י"א דאם הוא לאחר זמן השכירות שיכול לומר פרעתי או לא שכרתי מעולם ונפל טענה בין המשכיר והשוכר אע"ג שקרקע בחזקת בעליה עומדת השוכר נאמן במיגו (נ"י פרק השואל והמקבל):

One who lets a house to his fellow by a document for ten years, and there is no date in it: the tenant says, "Only one year of the time of the document has passed", and the landlord says, "They have already passed, and the years of the rental are complete, and you have dwelt ten years" — the tenant must bring proof; and if he did not bring proof, the landlord swears the oath of hesset and puts him out (and the same is the law in the other claims between them) (Mordechai, end of chapter "One who borrows"). However, some say that if it is after the time of the rental, when he can say "I paid" or "I never rented", and a claim fell between the landlord and the tenant, then even though land stands in the presumption of its owner, the tenant is believed by a migo (a plea he could have made in which he would have been believed) (Nimukei Yosef, chapters "One who borrows" and "One who receives").

Se’if 3ג׳

שטר השכירות או שטר המשכנתא שכתוב בו שנים סתם בעל הפירות אומר שלשה ובעל הקרקע אומר ב' וקדם זה השוכר או המלוה ואכל הפירות הרי הפירות בחזקת אוכליהם עד שיביא בעל הקרקע ראיה ויש מי שאומר שאם יראה ב"ד שלא יוכל השוכר או הממשכן לברר עוד דבריו מוציאין מידו:

A document of rental, or a document of mashkanta (a mortgage in which the lender eats the produce of the land), in which "years" is written without specifying: the owner of the produce says "three" and the owner of the land says "two"; and this tenant or lender went ahead and ate the produce — the produce stands in the presumption of those who ate it until the owner of the land brings proof. And there is one who says that if the court sees that the tenant or the holder of the pledge will not be able to clarify his words further, they take it out of his hand.
