One who lets a house to his fellow for a fixed time, and the tenant wished to let it to others; it contains three se'ifim. One who lets a house to his fellow for a fixed time, and the tenant wished to let the house to another — he lets it until the end of his time, provided the number of the other's household is not more than his own household. And if the landlord said to him, "Why should you trouble to let my house to others? If you do not wish to stay in it, go out and leave it, and I release you from its rent", they listen to him. Hagah [Rema]: And see above, siman 312, se'if 7. And if the tenant wishes to leave the house and leave it so, without dwellers, and wishes to pay the landlord, the landlord can let it to others, for a house that is lived in holds up, and "the gate is smitten with desolation" (Isaiah 24:12) (Mordechai, chapter "The presumption of houses"). One who gave his house to another, or let it to him, and reserved a right for himself that whenever he wishes he can live in the house with the recipient of the gift or the tenant — he can sell his right to another, provided the members of his household are not many (the Rashba, siman 1145). And some distinguish: if he reserved for himself a defined portion, such as half the house, then he can sell it to another; but if he reserved for himself a portion that is not defined, such that he can remove him, he cannot sell it or let his right to another (Rivash, siman 257). One who gives another a dwelling in his house, and the recipient does not need that dwelling — it seems to me that he can let it or sell it to another whose household is not more numerous than his, for the power of the recipient of a gift is not less than the power of one who reserves for himself, since one who gives, gives with a generous eye; and see above, siman 154, se'if 28.

Se’if 2ב׳

שנים ששכרו בית בשותפות לדור בו יחד אין אחד מהשותפין יכול להושיב אחר במקומו אפי' יש לו דיורין פחותים ממנו כי יכול לומר אותך אני יכול לקבל אבל אחר איני יכול לקבל ואינו יכול לכופו לחלוק שהבית אינו שלהם אלא שכור להם לזמן (וע"ל סי' קע"א סעיף ט' דיש חולקין ):

Two who rented a house in partnership to live in it together — neither of the partners can seat another in his place, even if his dwellers are fewer than he, for he can say, "You I can accept, but another I cannot accept"; and he cannot compel him to divide, for the house is not theirs, but only hired to them for a time (and see above, siman 171, se'if 9, that there are those who disagree).

Se’if 3ג׳

ראובן משכן ביתו לזמן והתנה שאחר הזמן יהיה רשות (בידו) לדור בו הוא וסייעתו או למשכן או להשכיר למי שירצה יש מי שאומר שאפי' בלא תנאי רשאי להשכיר או למשכן למי שבני ביתו אינן מרובין) ומפני התנאי רשאי להשכיר ולמשכן אפי' למי שיש סיעה גדולה מסיעתו:

Reuven pledged his house for a time and stipulated that after the time the right would be (in his hand) to live in it, he and his company, or to pledge it or let it to whomever he wishes. There is one who says that even without a condition he is permitted to let it or pledge it to one whose household is not more numerous; and because of the condition he is permitted to let it and pledge it even to one who has a larger company than his own company.
